  2         An act relating to the Florida Public Service

  3         Commission Nominating Council; amending s.

  4         350.031, F.S.; providing that members shall

  5         serve at the pleasure of the appointing

  6         authority or the appointing authority's

  7         successor; providing for one 4 year term;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (1) of section 350.031, Florida

13  Statutes, is amended to read:

14         350.031  Florida Public Service Commission Nominating

15  Council.--

16         (1)  There is created a Florida Public Service

17  Commission Nominating Council consisting of nine members. At

18  least one member of the council must be 60 years of age or

19  older.  Three members, including one member of the House of

20  Representatives, shall be appointed by the Speaker of the

21  House; three members, including one member of the Senate,

22  shall be appointed by the President of the Senate; and three

23  members shall be selected and appointed by a majority vote of

24  the other six members of the council. Members of the council

25  shall serve at the pleasure of the appointing authority or the

26  appointing authority's successor.  Members shall be limited to

27  one 4 year term, All terms shall be for 4 years except those

28  members of the House and Senate, who shall serve no more than

29  2-year terms concurrent with the 2-year elected terms of House

30  members. Vacancies on the council shall be filled for the

  1  unexpired portion of the term in the same manner as original

  2  appointments to the council.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
