1 A bill to be entitled
2 An act relating to athletic agents; creating s.
3 468.45615, F.S.; prohibiting the provision of
4 illegal inducements to athletes; providing
5 penalties; amending s. 468.4562, F.S.;
6 providing for the award of treble damages to
7 colleges or universities which prevail in civil
8 actions with respect to illegal acts by
9 athletic agents; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 468.45615, Florida Statutes, is
14 created to read:
15 468.45615 Provision of illegal inducements to athletes
16 prohibited; penalties; license suspension.--
17 (1) No person licensed pursuant to this part may
18 provide illegal inducements to an athlete in violation of this
19 part.
20 (2) In addition to any other penalties provided for in
21 this part for the provision of illegal inducements to an
22 athlete, a person convicted of a violation under the
23 provisions of this section:
24 (a) Commits a felony of the second degree, punishable
25 as provided in ss. 775.082, 775.083, 775.084, 775.089, and
26 775.091.
27 (b) Shall have any license issued pursuant this part
28 suspended.
29 (c) May not employ, utilize, or otherwise collaborate
30 with a licensed or unlicensed athletic agent in Florida to
31 recruit clients.

1 Section 2. Subsection (3) of section 468.4562, Florida
2 Statutes, is amended to read:
3 468.4562 Civil action by institution.--
4 (1) A college or university may sue for damages, as
5 provided by this section, any person who violates this part.
6 A college or university may seek equitable relief to prevent
7 or minimize harm arising from acts or omissions which are or
8 would be a violation of this part.
9 (3) An institution that prevails in a suit brought
10 under this section may recover:
11 (a) Actual damages;
12 (b) Punitive damages;
13 (c) Treble damages;
14 (d)(c) Court costs; and
15 (e)(d) Reasonable attorney's fees.
16 Section 3. This act shall take effect October 1, 2000.

Provides additional penalties with respect to athletic
21 agents who provide illegal inducements to athletes.
Authorizes the award of treble damages to institutions
22 which prevail in civil actions against athletic agents
who commit illegal acts in the recruitment of athletes.
