  1                      A bill to be entitled

  2         An act relating to resource recovery and

  3         management; amending s. 403.703, F.S.; revising

  4         the definition of "source separated"; providing

  5         an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (44) of section 403.703, Florida

10  Statutes, is amended to read:

11         403.703  Definitions.--As used in this act, unless the

12  context clearly indicates otherwise, the term:

13         (44)  "Source separated" means the recovered materials

14  are separated from solid waste where the recovered materials

15  and solid waste are generated. The term does not require that

16  various types of recovered materials be separated from each

17  other and recognizes de minimis solid waste, in accordance

18  with industry standards and practices, may be included in the

19  recovered materials. Materials shall not be deemed to be

20  source separated where two or more types of recovered

21  materials are deposited in combination with each other in a

22  commercial collection container located where the materials

23  are generated, and such materials contain more than 10 percent

24  solid waste by volume. For purposes of this subsection,

25  "various types of recovered materials" means metals, paper,

26  glass, plastic, textiles, and rubber.

27         Section 2.  This act shall take effect upon becoming a

28  law.

      For purposes of pt. IV of ch. 403, F.S., relating to
  4    resource recovery and management, revises the definition
      of "source separated" to provide that materials shall not
  5    be deemed to be source separated where two or more types
      of recovered materials are deposited in combination with
  6    each other in a commercial collection container located
      where the materials are generated, and such materials
  7    contain more than 10 percent solid waste by volume.
