1 A bill to be entitled
2 An act relating to reprocessed medical devices;
3 providing legislative findings and purpose
4 relating to reprocessed medical devices;
5 authorizing the use of such devices; providing
6 an effective date.

8 WHEREAS, medical device manufacturers have designated
9 certain medical devices as being for single use only, and
10 WHEREAS, a significant body of peer-reviewed scientific
11 research demonstrates that some medical devices labeled as
12 being for single use only can be properly reprocessed and
13 reused, with no added risk to patient safety, and
14 WHEREAS, the unnecessary disposal of certain medical
15 devices labeled as being for single use only exacerbates this
16 state's growing environmental waste problem and leads to
17 increased medical care costs, and
18 WHEREAS, proper reprocessing of certain medical devices
19 labeled as being for single use only is a practice that is
20 safe for patients and enables hospitals to achieve significant
21 cost savings, NOW, THEREFORE,

23 Be It Enacted by the Legislature of the State of Florida:
24
25 Section 1. Reprocessed medical devices originally
26 labeled as being for single use only may be used in this state
27 if the reprocessing is performed in compliance with the
28 applicable requirements enforced by the Federal Food and Drug
29 Administration.
30 Section 2. This act shall take effect upon becoming a
31 law.
