11  Senator Forman moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 2, between lines 23 and 24,

15

16  insert:

17         Section 2.  Section 30.525, Florida Statutes, is

18  created to read:

19         30.525  Deposit of moneys or bonds as bail not remitted

20  to clerk.--The sheriff may deposit any moneys or bonds

21  received as bail, which are not otherwise remitted to the

22  clerk pursuant to s. 903.16, in interest-bearing accounts.

23  Any interest earned shall be remitted to the county as

24  required by resolution of the board of county commissioners,

25  but not less than on a monthly basis.  The county shall use

26  the interest funds received to enhance criminal justice

27  programs within the county.

28         Section 3.  Subsection (1) of section 903.16, Florida

29  Statutes, is amended to read:

30         903.16  Deposit of money or bonds as bail.--

31         (1)  A defendant who has been admitted to bail, or

 1  another person in the defendant's behalf, may deposit with the

 2  official authorized to take bail money or nonregistered bonds

 3  of the United States, the state, or a city, town, or county in

 4  the state, equal in market value to the amount set in the

 5  order and the personal bond of the defendant and an

 6  undertaking by the depositor if the money or bonds are

 7  deposited by another.  The sheriff or other officials may

 8  remit money or bonds received to the clerk to be held by the

 9  clerk pending court action or return to the defendant or

10  depositor.  The clerk shall accept money or bonds remitted by

11  the sheriff and shall deposit such funds in interest-bearing

12  accounts and allocate the interest pursuant to s. 28.33.

21  insert:

22         creating s. 30.525, F.S.; authorizing sheriffs

25         deposit and use of interest on such moneys;

26         amending s. 903.16, F.S.; providing for deposit

27         into interest-bearing accounts; providing for

28         disposition and use of interest on such moneys;
