  1                      A bill to be entitled

  2         An act relating to judicial elections; amending

  3         s. 105.041, F.S.; providing procedure for

  4         determining the position on the ballot of the

  5         names of candidates for the office of circuit

  6         judge; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (2) of section 105.041, Florida

11  Statutes, is amended to read:

12         105.041  Form of ballot.--

13         (2)  LISTING OF CANDIDATES.--

14         (a)  Except as provided in paragraph (b), the order of

15  nonpartisan offices appearing on the ballot shall be

16  determined by the Department of State. The names of candidates

17  for election to each nonpartisan office shall be listed in

18  alphabetical order.  With respect to retention of justices and

19  judges, the question "Shall Justice (or Judge) (name of

20  justice or judge) of the (name of the court) be retained in

21  office?" shall appear on the ballot in alphabetical order and

22  thereafter the words "Yes" and "No."

23         (b)1.  The names of all candidates for the office of

24  circuit judge of a single-county circuit shall be listed on

25  the ballot in the order determined by lot conducted by the

26  supervisor of elections after the close of the qualifying

27  period.

28         2.  The names of all candidates for the office of

29  circuit judge of a multicounty circuit shall be listed on the

30  ballot in the order determined by lot conducted by the

  1  director of the Division of Elections of the Department of

  2  State after the close of the qualifying period.

  3         3.  Candidates who have secured a position on the

  4  general election ballot, after having survived elimination at

  5  the first primary, shall have their names listed in the same

  6  order as on the first primary ballot, notwithstanding the

  7  elimination of any intervening names as a result of the first

  8  primary.

  9         Section 2.  This act shall take effect upon becoming a

10  law.

14    Provides that the names of candidates for the office of
      circuit judge must be placed on the ballot in the order
15    determined by lot. Provides procedures.
