11  Senator Horne moved the following amendment to amendment

12  (232976):

14         Senate Amendment (with title amendment) 

15         On page 6, lines 6-23, delete those lines

16

17  and insert:  the application. If the district school board

18  fails to act on the application, an applicant may appeal to

19  the State Board of Education as provided in paragraph (b). If

20  an application is denied, the district school board must,

21  within 10 calendar days, articulate in writing the specific

22  reasons based upon good cause supporting its denial of the

23  charter application. For budget projection purposes, the

24  district school board or other sponsor shall report to the

25  department the approval or denial of a charter application

26  within 10 calendar days after such approval or denial. In the

27  event of approval, the report to the department must include

28  the final projected FTE for the approved charter school. Upon

29  approval of a charter application, the initial startup must be

30  consistent with the beginning of the public school calendar

31  for the district in which the charter is granted unless the

 1  district school board allows a waiver of this provision for

 2  good cause.

 3         (b)  An applicant may appeal any denial of that

 4  applicant's person's application or failure to act on an

 5  application to the State Board of Education no later than 30

 6  calendar days after the district school board's decision or

 7  failure to act and shall notify the district school board of
