  1                      A bill to be entitled

  2         An act relating to university health care;

  3         amending s. 240.513, F.S.; revising language

  4         with respect to the J. Hillis Miller Health

  5         Center; authorizing the nonprofit corporation

  6         leasing the facility to operate certain other

  7         facilities and programs; amending s. 626.852,

  8         F.S.; providing that part VI of the Florida

  9         Insurance Code regulating adjusters does not

10         apply to employees or agents of the Board of

11         Regents; amending s. 240.5135, F.S.; changing

12         references to Shands Jacksonville Healthcare,

13         Inc., and expanding the entities that may be

14         insured under it; providing an effective date.

16  Be It Enacted by the Legislature of the State of Florida:

17

18         Section 1.  Paragraph (a) of subsection (4) of section

19  240.513, Florida Statutes, is amended to read:

20         240.513  University of Florida; J. Hillis Miller Health

21  Center.--

22         (4)(a)  The State Board of Education shall lease the

23  hospital facilities of the health center, known as the Shands

24  Teaching Hospital and Clinics, and consisting of Building 446

25  and parts of Buildings 204 and 205 on the campus of the

26  University of Florida and all furnishings, equipment, and

27  other chattels or choses in action used in the operation of

28  the hospital, to a private nonprofit corporation organized

29  solely for the purpose of operating the hospital and ancillary

30  health care facilities of the health center and other health

31  care facilities and programs determined to be necessary by the

  1  board of the nonprofit corporation.  The rental for the

  2  hospital facilities shall be an amount equal to the debt

  3  service on bonds or revenue certificates issued solely for

  4  capital improvements to the hospital facilities or as

  5  otherwise provided by law.  The board shall request

  6  recommendations from the Board of Regents of the State

  7  University System as to the terms of the lease not otherwise

  8  provided for in this act.

  9         Section 2.  Section 626.852, Florida Statutes, is

10  amended to read:

11         626.852  Scope of this part.--

12         (1)  This part applies only to insurance adjusters as

13  defined in this part.

14         (2)  Unless otherwise required by context, the term

15  "adjusters" as used in this part applies to all licensees

16  defined as any type of adjuster.

17         (3)  This part does not apply as to life insurance or

18  annuity contracts.

19         (4)  This part does not apply to third-party

20  administrators or a person employed by a third-party

21  administrator holding a certificate of authority pursuant to

22  ss. 626.88-626.894.

23         (5)  This part does not apply to any employee or agent

24  of the Board of Regents providing services in support of any

25  self-insurance program adopted by such Board of Regents.

26         Section 3.  Section 240.5135, Florida Statutes, is

27  amended to read:

28         240.5135  Shands University Hospital of Jacksonville

29  Healthcare, Inc. and Faculty Clinic; Board of Regents

30  authorized to provide insurance.--The Board of Regents is

31  authorized to provide to Shands University Hospital of

  1  Jacksonville Healthcare and Faculty Clinic, Inc., and its

  2  not-for-profit subsidiaries and affiliates and any successor

  3  corporation that acts in support of the Board of Regents,

  4  comprehensive general liability coverage insurance, including

  5  professional liability, from the self-insurance programs

  6  insurance trust funds established pursuant to s. 240.213.

  7         Section 4.  This act shall take effect July 1, 2000.
