1 A bill to be entitled
2 An act relating to the South Indian River Water
3 Control District, Palm Beach County; amending
4 chapter 71-820, Laws of Florida, as amended;
5 authorizing the Board of Supervisors of the
6 South Indian River Water Control District to
7 receive and maintain real and personal property
8 for recreational purposes for land within the
9 District lying East of Canal 18 of the South
10 Florida Water Management District only;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 6 of chapter 71-820, Laws of
16 Florida, as amended, is amended to read:
17 Section 6. The Board of Supervisors of the South
18 Indian River Water Control District in Palm Beach County,
19 Florida, is hereby authorized, empowered and permitted to
20 expend funds of the District to pay for engineering studies
21 for the purpose of planning a road improvement program, and to
22 pay for the construction, maintenance, improvement and repair
23 of dedicated roads and road rights-of-way, including the
24 swales thereof, within the District where such construction,
25 maintenance, improvement and repair is not performed by other
26 governmental bodies and to levy special assessments on the
27 basis of parcels benefited rather than acres benefited for
28 said purposes. The Board of Supervisors of the South Indian
29 River Water Control District in Palm Beach County, Florida, is
30 hereby further authorized to expend funds of the District not
31 in excess of $500,000 for the purchase of equipment and other

1 facilities to be used for the purpose of construction,
2 maintenance, improvement and repair of dedicated roads and
3 road rights-of-way including the swales thereof (where such
4 construction, maintenance and repair are not performed by
5 other governmental bodies), and drainage works and other works
6 in the District, and to levy special assessments for said
7 purposes. The Board of Supervisors of the South Indian River
8 Water Control District is further authorized, empowered and
9 permitted to expend funds of the District to pay for
10 engineering studies for the purpose of planning facilities to
11 provide potable water distribution and waste water collection
12 systems to those lands lying East of Canal 18 of the South
13 Florida Water Management District, and to the Northeast
14 Quarter (NE 1/4) of the Northeast Quarter (NE 1/4) plus the
15 North one-half (N 1/2) of the North one-half (N 1/2) of the
16 Southeast Quarter (SE 1/4) of the Northeast Quarter (NE 1/4)
17 of Section 1, Township 41 South, Range 41 East, in Palm Beach
18 County, Florida, in cooperation with the Town of Jupiter and
19 the Loxahatchee River Environmental Control District, and to
20 pay for the construction, maintenance, improvement and repair
21 of those facilities where such construction, maintenance,
22 improvement and repair is not performed by other governmental
23 bodies, and to levy special assessments, on the basis of
24 parcels or front footage benefited rather than acres
25 benefited, for said purposes, and to transfer said facilities
26 to the Town of Jupiter and the Loxahatchee River Environmental
27 Control District for operation and maintenance. The Board of
28 Supervisors of the South Indian River Water Control District
29 is further authorized to receive and maintain real and
30 personal property for recreational purposes for land within
31 the District lying East of Canal 18 of the South Florida Water

1 Management District only; and to make it available for the use
2 of the landowners. The Board of Supervisors is authorized to
3 expend funds of the District to pay for the maintenance of
4 such property, the cost of which shall be borne by the
5 landowners owning land lying East of Canal 18 of the South
6 Florida Water Management District.
7 Section 2. This act shall take effect upon becoming a
8 law.
