1 A bill to be entitled
2 An act relating to Rodman Reservoir Recreation
3 Area; creating s. 258.16, F.S.; designating and
4 establishing a state recreation area; providing
5 duties of the Division of Recreation and Parks
6 of the Department of Environmental Protection;
7 providing for closure of certain structures;
8 providing for approval by the Legislature of
9 actions which would substantially alter the
10 recreation area; authorizing the Division of
11 State Lands of the department to acquire
12 contiguous property; requiring the Division of
13 State Lands to notify certain easement holders
14 of the state recreation area designation;
15 requiring a report to the Governor and
16 Legislature; providing an effective date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Section 258.16, Florida Statutes, is
21 created to read:
22 258.16 Rodman Reservoir Recreation Area designated.--
23 (1) There is designated and established a state
24 recreation area to be known as Rodman Reservoir Recreation
25 Area, in Marion and Putman Counties, which shall include all
26 state-owned lands within the floodplain of the Oklawaha River
27 and those hereafter acquired by the state from Eureka Dam in
28 Marion County to Buckman Lock in Putnam County. Such lands
29 shall be deemed and held to be a state recreation area, under
30 the supervision of the Division of Recreation and Parks of the
31 Department of Environmental Protection, and the division is

1 charged with the duty of providing for the development of
2 multipurpose recreational opportunities at this recreation
3 area and the care, upkeep, maintenance, and beautification of
4 the Rodman Reservoir Recreation Area, including all those
5 dams, locks, and other structures transferred by the Federal
6 Government to the state. Such structures may be permanently
7 closed and filled with suitable materials if their continued
8 maintenance and operation is determined by the department not
9 to be cost-effective due to the overall condition of the
10 structures when they were transferred by the Federal
11 Government. The Department shall not adopt any rules or
12 regulations, nor utilize any existing rules or regulations,
13 prohibiting recreational opportunities, including, but not
14 limited to hunting and fishing, in the Rodman Reservoir
15 Recreational Area. Any proposed action that would
16 substantially alter the recreation area as it existed on
17 January 1, 2000, shall be approved by the Legislature prior to
18 implementation.
19 (2) The Division of State Lands may acquire in the
20 name of the Board of Trustees of the Internal Improvement
21 Trust Fund any additional property adjacent or contiguous to
22 the Rodman Reservoir Recreation Area, from private owners or
23 from the United States Government, for improved management and
24 recreational opportunities.
25 (3) The Division of State Lands is directed to
26 identify, contact, and inform all property owners who entered
27 into easements located within the taking line of the Rodman
28 Reservoir of the designation of this area as a state
29 recreation area.
30 (4) By January 1, 2001, the Division of State Lands is
31 directed to submit a report to the Executive Office of the

1 Governor, the President of the Senate, and the Speaker of the
2 House of Representatives that:
3 (a) Identifies each entity that has an easement within
4 the taking line of the reservoir.
5 (b) Indicates whether the holder of the easement is
6 willing to sell the easement.
7 (c) Estimates the cost of acquiring the easements.
8 (d) Identifies any additional issues resulting from
9 this designation.
10 Section 2. This act shall take effect July 1, 2000.
