3 creating s. 311.13, F.S.; exempting specified
4 information relating to seaports from public
5 records requirements; providing for future
6 review and repeal; providing a statement of
7 public necessity; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 311.13, Florida Statutes, is
12 created to read:
13 311.13 Certain information exempt from
14 disclosure.--Seaport security plans of a seaport authority
15 created by act of the Legislature or of a seaport department
16 of a county or municipality that operates a seaport are exempt
17 from the provisions of s. 119.07(1) and s. 24(a), Art. I of
18 the State Constitution. In addition, photographs, maps,
19 blueprints, drawings, and similar materials that depict
20 critical seaport operating facilities are exempt from the
21 provisions of s. 119.07(1) and s. 24(a), Art. I of the State
22 Constitution, to the extent that a seaport authority created
23 by act of the Legislature or a seaport department of a county
24 or municipality that operates a seaport reasonably determines
25 that such items contain information that is not generally
26 known and that could jeopardize the security of the seaport;
27 however, information relating to real estate leases, layout
28 plans, blueprints, or information relevant thereto is not to
29 be included in this exemption. The exemptions in this section
30 are applicable only to records held by a seaport authority
31 created by act of the Legislature or to records of a county or

1 municipal seaport department that operates a seaport. This
2 section is subject to the Open Government Sunset Review Act of
3 1995 in accordance with s. 119.15, and shall stand repealed on
4 October 2, 2005, unless reviewed and saved from repeal through
5 reenactment by the Legislature.
6 Section 2. The Legislature finds that seaports
7 constitute a major point of entry for illicit drugs and other
8 contraband and are potential targets for terrorist activities.
9 The Legislature further finds that an exemption from public
10 disclosure for seaport security plans and certain photographs,
11 maps, blueprints, drawings, and similar materials that depict
12 critical seaport operating facilities is narrowly tailored to
13 serve a public purpose and is necessary to ensure the safety
14 and security of seaports.
15 Section 3. This act shall take effect upon becoming a
16 law.
