2 An act relating to compulsive gambling;
3 authorizing the Department of the Lottery to
4 provide funding to establish within resources
5 specifically appropriated and pursuant to s.
6 20.19(17), F.S., a program for public
7 education, training, prevention, and treatment
8 related to compulsive gambling; amending s.
9 24.105, F.S.; requiring lottery personnel and
10 lottery retailers to receive certain education;
11 amending s. 24.112, F.S.; requiring retailers
12 of lottery tickets to provide notice of a
13 toll-free problem-gambling hotline; amending s.
14 550.054, F.S.; requiring pari-mutuel
15 permitholders to provide notice of a toll-free
16 problem-gambling hotline; amending s. 849.0931,
17 F.S.; requiring authorized bingo organizations
18 to provide notice of a toll-free
19 problem-gambling hotline; providing an
20 effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. Compulsive gambling program.--Within
25 resources specifically appropriated for this purpose up to $2
26 million, and consistent with section 20.19(17), Florida
27 Statutes, the Department of the Lottery shall establish a
28 program for public education, awareness, and training
29 regarding problem and compulsive gambling and the treatment
30 and prevention of problem and compulsive gambling. The program
31 must include:

1 (1) Maintenance of a compulsive-gambling advocacy
2 organization's toll-free problem-gambling telephone number to
3 provide crisis counseling and referral services to families
4 experiencing difficulty as a result of problem or compulsive
5 gambling.
6 (2) The promotion of public awareness regarding the
7 recognition and prevention of problem or compulsive gambling.
8 (3) Facilitation, through inservice training and other
9 means, of the availability of effective assistance programs
10 for problem and compulsive gamblers of all ages and family
11 members affected by problem and compulsive gambling.
12 (4) Studies to identify adults and juveniles in this
13 state who are, or who are at risk of becoming, problem or
14 compulsive gamblers.
15 Section 2. Subsection (22) is added to section 24.105,
16 Florida Statutes, to read:
17 24.105 Powers and duties of department.--The
18 department shall:
19 (22) Require appropriate department personnel and
20 lottery retailers, as determined by the department, to receive
21 education on problem and compulsive gambling provided by an
22 advocacy organization for problem and compulsive gambling to
23 be selected by the Department of the Lottery.
24 Section 3. Subsection (6) of section 24.112, Florida
25 Statutes, is amended to read:
26 24.112 Retailers of lottery tickets.--
27 (6) Every retailer shall post and keep conspicuously
28 displayed in a location on the premises accessible to the
29 public its certificate of authority and, with respect to each
30 game, a statement supplied by the department of the estimated
31 odds of winning some prize for the game. Every retailer shall

1 also post at least one sign with the statement "IF YOU OR
2 SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS AVAILABLE.
3 CALL (the toll-free number provided by the Department of the
4 Lottery)." Such signs must be posted and conspicuously
5 displayed in a location near the lottery play station or
6 check-out counter where instant or on-line lottery tickets are
7 purchased.
8 Section 4. Subsections (14) and (15) are added to
9 section 550.054, Florida Statutes, to read:
10 550.054 Application for permit to conduct pari-mutuel
11 wagering.--
12 (14) Each pari-mutuel permitholder shall post signs
13 with the following statement and the toll-free number provided
14 by the Department of the Lottery: "IF YOU OR SOMEONE YOU KNOW
15 HAS A GAMBLING PROBLEM, HELP IS AVAILABLE. CALL (the toll-free
16 number provided by the Department of the Lottery)." Such signs
17 shall be posted within 50 feet of each entrance commonly used
18 for access by the public and within 50 feet of each credit
19 location within the pari-mutuel facility.
20 (15) Each pari-mutuel permitholder shall print on all
21 daily racing programs provided by the permitholder or its
22 lessees to the public the following statement and the
23 toll-free number provided by the Department of the Lottery:
24 "IF YOU OR SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS
25 AVAILABLE. CALL (the toll-free number provided by the
26 Department of the Lottery)."
27 Section 5. Present subsection (13) of section
28 849.0931, Florida Statutes, is amended and renumbered as
29 subsection (14), and a new subsection (13) is added to that
30 section, to read:

1 849.0931 Bingo authorized; conditions for conduct;
2 permitted uses of proceeds; limitations.--
3 (1) As used in this section:
4 (13) Each organization conducting bingo open to the
5 public shall post signs with the following statement and the
6 toll-free number provided by the Department of the Lottery "IF
7 YOU OR SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS
8 AVAILABLE. CALL (the toll-free number provided by the
9 Department of the Lottery)." Such signs shall be posted within
10 50 feet of each entrance commonly used for access by the
11 public to the premises at which bingo is conducted by the
12 organization.
13 (14)(13) Any organization or other person who
14 willfully and knowingly violates any provision of subsections
15 (1)-(12) commits this section is guilty of a misdemeanor of
16 the first degree, punishable as provided in s. 775.082 or s.
17 775.083. An For a second or subsequent offense, the
18 organization or other person who commits a second or
19 subsequent offense commits is guilty of a felony of the third
20 degree, punishable as provided in s. 775.082, s. 775.083, or
21 s. 775.084.
22 Section 6. This act shall take effect July 1, 2000.

25 SENATE SUMMARY
26 Requires the Department of the Lottery to establish,
within resources specifically appropriated up to $2
27 million, a program for public education, awareness, and
training relating to problem and compulsive gambling and
28 the treatment and prevention of problem and compulsive
gambling. Prescribes criteria to be included in such
29 program. Provides that the Department of the Lottery
shall require department personnel and lottery retailers
30 to receive education on problem and compulsive gambling.
Requires lottery retailers, pari-mutuel permitholders,
31 and authorized bingo organizations to provide notice of
the availability of a toll-free problem-gambling hotline.
