  1                      A bill to be entitled

  2         An act relating to the Lake Okeechobee

  3         Protection Trust Fund; creating s. 373.45952,

  4         F.S.; creating the Lake Okeechobee Protection

  5         Trust Fund; providing for administration by the

  6         Department of Environmental Protection;

  7         providing for its purposes; providing for

  8         review and termination or re-creation of the

  9         trust fund; providing a contingent effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 373.45952, Florida Statutes, is

15  created to read:

16         373.45952  Lake Okeechobee Protection Trust Fund.--

17         (1)  The Lake Okeechobee Protection Trust Fund is

18  created within the Department of Environmental Protection.

19         (2)  Funds to be credited to the trust fund consist of

20  funds appropriated annually by the Legislature and as provided

21  for by general law. Funds may be used solely for the purposes

22  set forth in s. 373.4595 and for related purposes undertaken

23  under ss. 373.451-373.459.

24         Section 2.  In accordance with Section 19(f)(2),

25  Article III of the State Constitution, the Lake Okeechobee

26  Protection Trust Fund shall be terminated on July 1, 2004,

27  unless terminated sooner. Before its scheduled termination,

28  the trust fund shall be reviewed as provided in section

29  215.3206(1) and (2), Florida Statutes.

30         Section 3.  This act shall take effect on the effective

31  date of Senate Bill 1494, but it shall not take effect unless

  1  it is enacted by a three-fifths vote of the membership of each

  2  house of the Legislature and unless SB    , 2000 Regular

  3  Session, becomes a law.

  7    Creates the Lake Okeechobee Protection Trust Fund to be
      administered by the Department of Environmental
