2 An act relating to political committees;
3 amending s. 106.011, F.S.; redefining the term
4 "political committee" for purposes of the
5 campaign finance laws; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (1) of section 106.011, Florida
11 Statutes, is amended to read:
12 106.011 Definitions.--As used in this chapter, the
13 following terms have the following meanings unless the context
14 clearly indicates otherwise:
15 (1) "Political committee" means a combination of two
16 or more individuals, or a person other than an individual, the
17 major primary or incidental purpose of which is to support or
18 oppose any candidate, issue, or political party. For purposes
19 of this subsection, the term "major purpose" means making or
20 accepting which accepts contributions or making makes
21 expenditures to expressly advocate the election or defeat of a
22 candidate or issue during a calendar year in an aggregate
23 amount in excess of $500.; "Political committee" also means
24 the sponsor of a proposed constitutional amendment by
25 initiative who intends to seek the signatures of registered
26 electors. Organizations which are certified by the Department
27 of State as committees of continuous existence pursuant to s.
28 106.04, national political parties, and the state and county
29 executive committees of political parties regulated by chapter
30 103 shall not be considered political committees for the
31 purposes of this chapter. Corporations regulated by chapter

1 607 or chapter 617 or other business entities formed for
2 purposes other than to support or oppose issues or candidates
3 are not political committees if their political activities are
4 limited to contributions to candidates, political parties, or
5 political committees or expenditures in support of or
6 opposition to an issue from corporate or business funds and if
7 no contributions are received by such corporations or business
8 entities.
9 Section 2. This act shall take effect upon becoming a
10 law.
