17 Section 1. Section 232.61, Florida Statutes, is
18 amended to read:
19 232.61 Governing organization for athletics; adoption
20 of bylaws.--
21 (1) The organization shall adopt bylaws that, unless
22 specifically provided by statute, establish eligibility
23 requirements for all students who participate in high school
24 athletic competition in its member schools. The bylaws
25 governing residence and transfer shall allow the student to be
26 eligible in the school in which he or she first enrolls each
27 school year, or makes himself or herself a candidate for an
28 athletic team by engaging in a practice prior to enrolling in
29 any member school. The student shall be eligible in that
30 school so long as he or she remains enrolled in that school.
31 Subsequent eligibility shall be determined and enforced

1 through the organization's bylaws. Where the student lives,
2 with whom the student lives, or which school the student
3 attended the previous year shall not be a factor in
4 determining eligibility.
5 (2) The organization shall also adopt bylaws that
6 specifically prohibit the recruiting of students for athletic
7 purposes. The bylaws shall prescribe penalties and an appeals
8 process for athletic recruiting violations.
9 (3) The organization shall adopt bylaws that require
10 all students participating in athletic competition or who are
11 candidates for an athletic team to satisfactorily pass a
12 complete physical examination each year prior to participating
13 in high school athletic competition or engaging in any
14 practice, tryout, workout, or other physical activity
15 associated with the student's candidacy for an athletic team.
16 Such physical examination must be administered by a
17 practitioner licensed under the provisions of chapter 458,
18 chapter 459, chapter 460, or s. 464.012 and in good standing
19 with the practitioner's appropriate regulatory board. Physical
20 examinations conducted by a podiatric physician licensed under
21 chapter 461, an optometrist licensed under chapter 463, or a
22 dentist licensed under chapter 466 shall not be acceptable for
23 purposes of satisfying the requirements of this paragraph. The
24 bylaws shall establish requirements for passing the physical
25 examination, which shall include minimum standards for the
26 physical capabilities necessary for participation in high
27 school athletic competition. Practitioners administering
28 physical examinations pursuant to this section must know the
29 minimum standards established by the organization and certify
30 that the student meets the standards. Results of such physical
31 examination must be provided to the athletic department of the

1 student's high school. No student shall be eligible to
2 participate in any athletic competition or engage in any
3 practice, tryout, workout, or other physical activity
4 associated with the student's candidacy for an athletic team
5 until the results of the physical examination verifying that
6 the student has satisfactorily passed the examination have
7 been received and approved by the athletic department.
8 (4) Notwithstanding the provisions of subsection (3),
9 a student may participate in athletic competition or be a
10 candidate for an athletic team if the parent or guardian of
11 the student objects in writing to the student undergoing a
12 physical examination because such examination is contrary to
13 his or her religious tenets or practices, provided that no
14 person shall be held liable for any injury or other damages
15 suffered by such student resulting from his or her
16 participation in athletic competition or in any practice,
17 tryout, workout, or other physical activity associated with
18 his or her candidacy for an athletic team.
