6 creating ss. 627.64091, 627.6681, F.S.;
7 requiring health insurance policies, insurers,
8 health maintenance organizations, and nonprofit
9 health care services that provide mental health
10 benefits to provide coverage for treatment of
11 social anxiety disorder; providing for
12 unenforceability of policies or contracts not
13 providing such coverage; amending s. 641.31,
14 F.S.; requiring health maintenance contracts
15 that include mental health coverage to include
16 coverage for social anxiety disorder; providing
17 an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Section 409.9051, Florida Statutes, is
22 created to read:
23 409.9051 Coverage for social anxiety disorder.--The
24 agency shall pay for medically necessary treatment of social
25 anxiety disorder. As used in this section, the term "social
26 anxiety disorder" means a condition that meets the criteria
27 for generalized social phobia set forth in the Diagnostic and
28 Statistical Manual of Mental Disorders, Fourth Edition, of the
29 American Psychiatric Association.
30 Section 2. Section 627.64091, Florida Statutes, is
31 created to read:

1 627.64091 Coverage for social anxiety disorder.--
2 (1) Each health insurance policy that provides
3 coverage for mental health benefits to residents of this state
4 and that is issued, amended, delivered, or renewed in this
5 state on or after January 1, 2001, must include coverage for
6 medically necessary treatment of social anxiety disorder.
7 (2) Any provision in any health insurance policy that
8 is issued, amended, delivered, or renewed in this state on or
9 after January 1, 2001, which conflicts with this section is
10 unenforceable.
11 (3) As used in this section, the term "social anxiety
12 disorder" means a condition that meets the criteria for
13 generalized social phobia set forth in the Diagnostic and
14 Statistical Manual of Mental Disorders, Fourth Edition, of the
15 American Psychiatric Association.
16 Section 3. Section 627.6681, Florida Statutes, is
17 created to read:
18 627.6681 Coverage for social anxiety disorder.--
19 (1) Each insurer, health maintenance organization, and
20 nonprofit health care services plan that provides group health
21 insurance policies or prepaid health care contracts that
22 include mental health benefits and that are issued, amended,
23 delivered, or renewed in this state on or after January 1,
24 2001, must include coverage for medically necessary treatment
25 of social anxiety disorder.
26 (2) Any provision in any health insurance policy or
27 health contract issued, amended, delivered, or renewed in this
28 state on or after January 1, 2001, which conflicts with this
29 section, is unenforceable.
30 (3) As used in this section, the term "social anxiety
31 disorder" means a condition that meets the criteria for

1 generalized social phobia set forth in the Diagnostic and
2 Statistical Manual of Mental Disorders, Fourth Edition, of the
3 American Psychiatric Association.
4 Section 4. Subsection (39) is added to section 641.31,
5 Florida Statutes, to read:
6 641.31 Health Maintenance Contracts.--
7 (39) Health maintenance contracts that provide mental
8 health coverage must include coverage for medically necessary
9 treatment of social anxiety disorder. As used in this section,
10 the term "social anxiety disorder" means a condition that
11 meets the criteria for generalized social phobia set forth in
12 the Diagnostic and Statistical Manual of Mental Disorders,
13 Fourth Edition, of the American Psychiatric Association.
14 Section 5. This act shall take effect January 1, 2001.

17 SENATE SUMMARY
18 Requires the Agency for Health Care Administration to pay
for medically necessary treatment of social anxiety
19 disorder. Provides that health insurance policies that
provide mental health benefits must provide coverage for
20 treatment of social anxiety disorder. Provides that
policies not providing such coverage are unenforceable.
21 Requires insurers, health maintenance organizations, and
nonprofit health care services that provide mental health
22 benefits to include coverage for social anxiety disorder.
Provides that policies or contracts not complying with
23 coverage for social anxiety disorder are unenforceable.
Provides that health maintenance contracts must include
24 coverage for social anxiety disorder.
