  1                      A bill to be entitled

  2         An act relating to adult workforce development

  3         education; creating s. 239.214, F.S.; creating

  4         the "Workforce Development Education

  5         Unification Act of 2000"; providing legislative

  6         intent; providing for the transfer of all

  7         public adult workforce development programs and

  8         area technical centers from school districts to

  9         community colleges; providing for the transfer

10         of educational plants and related equipment;

11         providing for the transfer of staff; providing

12         an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15

16         Section 1.  Section 239.214, Florida Statutes, is

17  created to read:

18         239.214  Workforce development education.--

19         (1)  This act may be cited as the "Workforce

20  Development Education Unification Act of 2000."

21         (2)  LEGISLATIVE INTENT.--It is the intent of the

22  Legislature to unify and consolidate the delivery of adult

23  workforce development education programs to accomplish the

24  following state-level priorities:

25         (a)  Focus public schools on the mission of educating

26  K-12 students.

27         (b)  Strengthen secondary vocational education programs

28  that prepare students for postsecondary workforce development

29  education opportunities.

30         (c)  Eliminate duplicative adult workforce development

31  education programs and services.

  1         (d)  Reduce administrative costs associated with the

  2  delivery of adult workforce development education.

  3         (e)  Identify single points of entry for businesses and

  4  students for workforce development certificate, adult

  5  education, and continuing workforce education.

  6         (f)  Provide one point of accountability relating to

  7  return on the investment of public dollars.

  8         (g)  Minimize waste by maximizing the transfer of

  9  credit hours without jeopardizing institutional accreditation.

10         (h)  Unify facilities' planning, funding, and

11  construction.

12         (3)  TRANSFER OF EXISTING ADULT WORKFORCE DEVELOPMENT

13  PROGRAMS.--All public adult workforce development programs and

14  all area technical centers shall be transferred to community

15  colleges effective July 1, 2001, at which time:

16         (a)  Responsibility for the provision of all public

17  adult workforce development education will be shifted from the

18  school district to the community college in whose service area

19  the adult workforce development education program is located.

20         (b)  School districts will be responsible for the

21  provision of secondary vocational education and community

22  colleges will be responsible for the provision of public adult

23  workforce development education.

24         (c)  The certification and accreditation status of an

25  adult workforce development education program shall be

26  unaffected by the transfer of the program to the respective

27  community college, which shall maintain all standards

28  necessary to continue to meet requirements for certification

29  and accreditation.

30         (d)  Area technical center and adult vocational program

31  educational facilities or educational plants, as defined in s.

  1  235.011(6) and (7), and related equipment, which are owned by

  2  the state and paid for with only state funds, shall be

  3  transferred to the community college in whose service area the

  4  area technical center is located. If a facility or educational

  5  plant is used for purposes in addition to adult vocational

  6  education, the State Board of Education shall mediate the

  7  transfer or the development and implementation of a suitable

  8  and equitable multiuse arrangement between the local district

  9  school board and the community college board of trustees.

10         (e)  Area technical center and adult vocational program

11  educational facilities or educational plants, as defined in s.

12  235.011(6) and (7), and related equipment, which are owned by

13  the school district and paid for in whole or in part with

14  local tax funds shall be leased to the community college in

15  whose service area the area technical center is located.

16  However, if such adult vocational program facility or

17  educational plant, or part of such facility or plant, is used

18  for other purposes in addition to adult vocational education,

19  the State Board of Education shall mediate a suitable and

20  equitable lease agreement between the local school board and

21  the community college board of trustees. If a school district

22  and a community college cannot agree on the terms and

23  conditions of the lease agreement, the State Board of

24  Education shall finalize the agreement and report its decision

25  to the Legislature.

26         (f)  The community college board of trustees may

27  provide for school district area technical center or adult

28  vocational center staff employed in full-time budgeted

29  positions to be transferred into the community college

30  personnel system at the same rate of salary.  Retirement and

31  leave provisions shall be transferred according to law.  In

  1  transferring staff from school districts to the community

  2  college, the community college shall make every effort

  3  possible to place current school district adult vocational

  4  center staff in the community college and to assist such staff

  5  in acquiring training and certification necessary to be

  6  employed in the community college's adult vocational education

  7  programs.

  8         (4)  ANALYSIS.--By December 31, 2000, the Bureau of

  9  Educational Facilities of the Department of Education, in

10  collaboration with the Department of Management Services,

11  shall conduct an analysis to determine the amount of local tax

12  contribution used in the construction of a

13  school-district-owned area technical center, other adult

14  vocational center, or other educational plant affected by the

15  transfer.  The local community college district board of

16  trustees may make a legislative budget request through the

17  State Board of Community Colleges to purchase the area

18  technical center facility or educational plant, or the

19  community college may continue to lease the facility from the

20  local school district.

21         Section 2.  No later than January 1, 2001, the Division

22  of Community Colleges shall submit to the President of the

23  Senate, the Speaker of the House of Representatives, and the

24  chairs of the appropriate substantive committees recommended

25  statutory revisions necessary to carry out the provisions of

26  this act.

27         Section 3.  This act shall take effect July 1, 2000.
