1 A bill to be entitled
2 An act relating to pharmacy practice; creating
3 s. 465.0075, F.S.; authorizing licensure of
4 pharmacists by endorsement and providing
5 requirements therefor, including a fee;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. Section 465.0075, Florida Statutes, is
11 created to read:
12 465.0075 Licensure by endorsement; requirements;
13 fee.--
14 (1) The department shall issue a license by
15 endorsement to any applicant who applies to the department and
16 remits a nonrefundable fee of not more than $100, as set by
17 the board, and whom the board certifies:
18 (a) Has met the qualifications for licensure in s.
19 465.007(1)(b)-(c);
20 (b) Has obtained a passing score, as established by
21 rule of the board, on the licensure examination of the
22 National Association of Boards of Pharmacy (NABPLEX) or a
23 similar national organization, if the board certifies that the
24 applicant has taken the required examination not more than 15
25 years prior to application;
26 (c)1. Has submitted evidence of the active licensed
27 practice of pharmacy in another jurisdiction for at least 2 of
28 the immediately preceding 5 years or evidence of successful
29 completion of board-approved postgraduate training or a
30 board-approved clinical competency examination within the year
31 immediately preceding application for licensure. For purposes

1 of this paragraph, "active licensed practice of pharmacy"
2 means the practice of pharmacy by pharmacists, including those
3 employed by any governmental entity in community or public
4 health, as defined by this chapter; or
5 2. Has completed an internship meeting the
6 requirements of s. 465.007(1)(c) within the 2 years
7 immediately preceding application; and
8 (d) Has obtained a passing score on the pharmacy
9 jurisprudence portions of the licensure examination, as
10 required by board rule.
11 (2) The department may not issue a license by
12 endorsement to any applicant who is under investigation in any
13 jurisdiction for an act or offense that would constitute a
14 violation of this chapter until the investigation is complete,
15 at which time the provisions of s. 465.016 apply.
16 (3) The department may not issue a license by
17 endorsement to any applicant whose license to practice
18 pharmacy has been suspended or revoked in another state or to
19 any applicant who is currently the subject of any disciplinary
20 proceeding in another state.
21 Section 2. This act shall take effect upon becoming a
22 law.

COMMITTEE SUBSTITUTE FOR
25 SB 168

27 The committee substitute restricts licensure by endorsement of
applicants who have taken the required licensure examination
28 no more than 15 years before their application. The bill
revises the requirements for the Board of Pharmacy and the
29 Department of Health to impose restrictions on a license by
endorsement for any act committed in another jurisdiction that
30 would constitute a violation of chapter 465. F.S.
