  1                      A bill to be entitled

  2         An act relating to pharmacy practice; creating

  3         s. 465.0075, F.S.; authorizing licensure of

  4         pharmacists by endorsement and providing

  5         requirements therefor, including a fee;

  6         amending s. 465.023, F.S.; providing for

  7         disciplinary actions against pharmacy

  8         permittees for interfering with or attempting

  9         to interfere with the professional judgment of

10         a pharmacist in the practice of the profession

11         of pharmacy; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Section 465.0075, Florida Statutes, is

16  created to read:

17         465.0075  Licensure by endorsement; requirements;

18  fee.--

19         (1)  The department shall issue a license by

20  endorsement to any applicant who applies to the department and

21  remits a nonrefundable fee of not more than $100, as set by

22  the board, and whom the board certifies:

23         (a)  Has met the qualifications for licensure in s.

24  465.007(1)(b)-(c);

25         (b)  Has obtained a passing score, as established by

26  rule of the board, on the licensure examination of the

27  National Association of Boards of Pharmacy (NABPLEX) or a

28  similar nationally recognized examination, if the board

29  certifies that the applicant has taken the required

30  examination not more than 15 years prior to application;

  1         (c)1.  Has submitted evidence of the active licensed

  2  practice of pharmacy in another jurisdiction for at least 2 of

  3  the immediately preceding 5 years or evidence of successful

  4  completion of board-approved postgraduate training or a

  5  board-approved clinical competency examination within the year

  6  immediately preceding application for licensure. For purposes

  7  of this paragraph, "active licensed practice of pharmacy"

  8  means the practice of pharmacy by pharmacists, including those

  9  employed by any governmental entity in community or public

10  health, as defined by this chapter; or

11         2.  Has completed an internship meeting the

12  requirements of s. 465.007(1)(c) within the 2 years

13  immediately preceding application; and

14         (d)  Has obtained a passing score on the pharmacy

15  jurisprudence portions of the licensure examination, as

16  required by board rule.

17         (2)  An applicant licensed in another state for a

18  period in excess of 2 years from the date of application for

19  licensure in this state shall submit a total of at least 30

20  hours of board-approved continuing education for the 2

21  calendar years immediately preceding application.

22         (3)  The department may not issue a license by

23  endorsement to any applicant who is under investigation in any

24  jurisdiction for an act or offense that would constitute a

25  violation of this chapter until the investigation is complete,

26  at which time the provisions of s. 465.016 apply.

27         (4)  The department may not issue a license by

28  endorsement to any applicant whose license to practice

29  pharmacy has been suspended or revoked in another state or to

30  any applicant who is currently the subject of any disciplinary

31  proceeding in another state.

  1         Section 2.  Paragraph (e) is added to subsection (1) of

  2  section 465.023, Florida Statutes, to read:

  3         465.023  Pharmacy permittee; disciplinary action.--

  4         (1)  The department or the board may revoke or suspend

  5  the permit of any pharmacy permittee, and may fine, place on

  6  probation, or otherwise discipline any pharmacy permittee who

  7  has:

  8         (e)  Interfered with or attempted to interfere with the

  9  professional judgment of a pharmacist in the practice of the

10  profession of pharmacy.

11         Section 3.  This act shall take effect upon becoming a

12  law.
