1 A bill to be entitled
2 An act relating to Cabinet reorganization;
3 providing legislative intent regarding the
4 impact of the amendment to the State
5 Constitution on the Commissioner of Education
6 and the State Board of Education; providing an
7 effective date.

9 WHEREAS, in November of 1998 the electorate of Florida
10 voted to amend the State Constitution, and
11 WHEREAS, that amendment provides for the modification
12 of the membership of the Cabinet effective January 7, 2003,
13 and
14 WHEREAS, that amendment provides that the Commissioner
15 of Education will not be a member of the Cabinet but will be
16 an appointee of the State Board of Education, and
17 WHEREAS, the amendment provides that the State Board of
18 Education will not consist of the Governor and Cabinet but
19 will consist of seven members who are appointed by the
20 Governor and confirmed by the Senate, NOW, THEREFORE,

22 Be It Enacted by the Legislature of the State of Florida:

24 Section 1. It is the intent of the Legislature that
25 when the Commissioner of Education is removed from the Cabinet
26 and becomes an appointee of the State Board of Education that
27 the transfer of any of the commissioner's responsibilities
28 will not disrupt the educational governance system of the
29 state and that the coordination of educational policies will
30 be improved.
31 Section 2. This act shall take effect January 7, 2003.
