  1                      A bill to be entitled

  2         An act relating to the Everglades Restoration

  3         Reserve Trust Fund; creating s. 373.472, F.S.;

  4         creating the trust fund within the Department

  5         of Environmental Protection; prescribing its

  6         uses and purposes; exempting the trust fund

  7         from service charges; providing for retention

  8         of interest or other earnings; providing for

  9         review and termination or re-creation of the

10         trust fund; providing a contingent effective

11         date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Section 373.472, Florida Statutes, is

16  created to read:

17         374.472  Everglades Restoration Reserve Trust Fund.--

18         (1)  There is created within the Department of

19  Environmental Protection the Everglades Restoration Reserve

20  Trust Fund. Funds in the trust fund shall be expended to

21  implement the Comprehensive Plan defined in s. 373.470(2)(a).

22  The trust fund shall serve as the repository for state, local,

23  and federal project contributions in accordance with s.

24  373.470(4) and (5).

25         (2)  The trust fund is not subject to the service

26  charge specified in s. 215.20(1). All income of a revenue

27  nature, including interest or other earnings received by or

28  credited to the trust fund, shall remain in the fund.

29         Section 2.  In accordance with Section 19(f)(2) of

30  Article III of the State Constitution, the Everglades

31  Restoration Reserve Trust Fund shall, unless terminated

  1  sooner, terminate on July 1, 2004. Before its scheduled

  2  termination, the trust fund shall be reviewed as provided in

  3  section 215.3206(1) and (2), Florida Statutes.

  4         Section 3.  This act shall take effect on the effective

  5  date of Senate Bill    , but it shall not take effect unless

  6  it is enacted by a three-fifths vote of the membership of each

  7  house of the Legislature and unless SB    , 2000 Regular

  8  Session, becomes a law.

12    Creates the Everglades Restoration Reserve Trust Fund to
      be administered by the Department of Environmental
13    Protection. Provides an exemption from service charges
      and retention of income. Provides for review and
