13 Amendment (with title amendment)
14 On page 1, line 28, through page 3, line 29,
15 remove from the bill: all of said lines
16
17 and insert in lieu thereof:
18 Section 2. Funds generated by sources of revenue from
19 Port Everglades activities and designated for firefighting
20 functions prior to the date of this act shall continue to be
21 designated for firefighting functions and shall be paid
22 annually to the City of Hollywood for firefighting functions.
23 Section 3. Prior to November 22, 2000, the Charter
24 government of Broward County shall deliver all books and
25 records relating to fire protection functions as described in
26 section 1 to the City of Hollywood and pay over all County
27 funds and moneys relating to fire protection functions as
28 described in section 1 to the City of Hollywood.
29 Section 4. Effective November 22, 2000, the City of
30 Hollywood shall assume all liability of Broward County
31 relating to fire protection functions as described in section

1 1, both known and unknown. All assets, including real,
2 personal, and intangible properties belonging to Broward
3 County, relating to fire protection functions as described in
4 section 1 shall become assets and property of the City of
5 Hollywood.
6 Section 5. Commencing on November 22, 2000, all
7 contracts, including all collective bargaining agreements, to
8 which the Charter government of Broward County is a party
9 relating to fire protection functions as described in section
10 1 shall remain in full force and effect for the period
11 provided in the contract, except that the City of Hollywood
12 shall be substituted for the Charter government of Broward
13 County. The City of Hollywood shall be entitled to all
14 benefits and subject to all liabilities under such contracts
15 and have the same rights and liabilities to perform, require
16 performance, and modify or terminate such contracts as the
17 Charter government of Broward County. If on the effective
18 date of transfer there is no collective bargaining agreement
19 in force between Broward County and the Port Everglades Fire
20 Fighters, the City of Hollywood shall honor all prior
21 provisions of the collective bargaining agreement which had
22 expired immediately prior to the transfer until a successor
23 agreement is in force pursuant to chapter 447, Florida
24 Statutes.
25 Section 6. All employees performing fire protection
26 functions that were employed as of September 6, 1999, as
27 described in section 1 shall, effective November 22, 2000, be
28 employees of the City of Hollywood, subject to all ordinances,
29 rules, and regulations of the City of Hollywood, except as
30 same conflict with any agreements as described in section 5.
31 Section 7. To the extent necessary to provide for the

1 protection of persons and property within the Port
2 Jurisdictional Area as described in section 1, the City of
3 Hollywood shall have such extra territorial powers as
4 necessary to perform all fire protection functions. This shall
5 include the power to adopt regulations necessary and proper
6 for fire protection services for the protection of persons and
7 property within the Port Jurisdictional Area. This shall also
8 include, but not be limited to, the authority to negotiate and
9 enter into interlocal agreements, shared services agreements,
10 and automatic response agreements with surrounding
11 municipalities for fire services in the Port Jurisdictional
12 Area of Port Everglades.
13 Section 8. Broward County shall maintain Emergency
14 Medical Services within the Port Jurisdictional Area as
15 outlined in interlocal agreements.
16 Section 9. This act shall take precedence over any
17 other prior enacted law.
18 Section 10. The item that shall appear on the ballot
19 on November 7, 2000, the date of the general election, shall
20 be as follows:
21 (Title) Transfer of Port Everglades fire
22 protection function to the City of Hollywood.
23 (Issue) All fire protection functions within
24 the Port Jurisdictional Area within Port
25 Everglades shall be transferred from Broward
26 County to the City of Hollywood.
