11  Senator Forman moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 4, between lines 9 and 10,

15

16  insert:

17         Section 3.  Section 60.08, Florida Statutes, is created

18  to read:

19         60.08  Injunctions sought by the Attorney General,

20  statewide prosecutor, or any state attorney shall issue

21  without bond.--Notwithstanding any other provision of law, any

22  injunction sought by the Attorney General, the statewide

23  prosecutor or any state attorney shall issue without bond or

24  surety and no bond or surety shall be required during the term

25  of the injunction. In any such injunctive actions, on

26  dissolution, the court may award to a person reasonable

27  attorney fees and costs or damages resulting from the

28  injunction only if the court finds that there was a complete

29  absence of a justiciable issue of either law or fact raised by

30  the Attorney General, the statewide prosecutor, or the state

31  attorney, or if the court finds bad faith on the part of the

 1  Attorney General, statewide prosecutor, or the state attorney.

 2         Section 4.  If any provision of this act or the

 3  application thereof to any person or circumstance is held

 4  invalid, the invalidity does not affect other provisions or

 5  applications of the act which can be given effect without the

 6  invalid provision or application, and to this end the

 7  provisions of this act are declared severable.

14         On page 1, lines 2 through 9, delete those lines

16  and insert:

17         An act relating to legal proceedings; creating

18         s. 768.733, F.S.; prescribing the amount of

19         bond or equivalent surety required to stay the

20         execution of punitive-damages judgments in

21         class-action suits, pending appellate review;

22         providing for application of the act to certain

23         pending cases; creating s. 60.08, F.s.;

24         providing for injunctions without bond;

25         providing fot attorney's fees; providing for

26         severability; providing an effective date.
