11  Senator Klein moved the following amendment:

13         Senate Amendment 

14         On page 3, lines 16-26, delete those lines

15

16  and insert:

17         (3)  The required bond or equivalent surety acceptable

18  to the court for imposition of the stay shall be the lower of:

19         (a)  The amount of the punitive-damages judgment, plus

20  twice the statutory rate of interest; or

21         (b)  Ten percent of the net worth of the defendant as

22  determined by applying generally accepted accounting

23  principles to the defendant's financial status as of December

24  31 of the year prior to the judgment for punitive damages.

26  Provided that in no case shall the amount of the required bond

27  or equivalent surety exceed $100 million, regardless of the

28  amount of punitive damages.
