17         the Board of Regents of the plan to transfer

18         State University System employees from career

19         service status; amending ss. 240.147, 240.296,

20         and 240.531, F.S.; conforming cross-references;

21         repealing s. 240.262(3), F.S., relating to a

22         deadline for submission of university

  4  Be It Enacted by the Legislature of the State of Florida:

  5

  6         Section 1.  Section 239.5142, Florida Statutes, is

  7  repealed.

  8         Section 2.  Section 239.5143, Florida Statutes, is

  9  repealed.

10         Section 3.  Section 239.5144, Florida Statutes, is

11  repealed.

12         Section 4.  Paragraph (g) of subsection (3) of section

13  240.209, Florida Statutes, is repealed.

14         Section 5.  Subsection (4) of section 240.147, Florida

15  Statutes, is amended to read:

16         240.147  Powers and duties of the commission.--The

17  commission shall:

18         (4)  Recommend to the State Board of Education

19  contracts with independent institutions to conduct programs

20  consistent with the state master plan for postsecondary

21  education. In making recommendations, the commission shall

22  consider the annual report submitted by the Board of Regents

23  pursuant to s. 240.209(3)(r)(s). Each program shall be

24  reviewed, with the cooperation of the institution, every 5

25  years.

26         Section 6.  Paragraph (d) of subsection (2) of section

27  240.296, Florida Statutes, is amended to read:

28         240.296  State University System Facilities Loan and

29  Debt Surety Program.--

  1         (d)  All construction allocations shall be acquired in

  2  accordance with rules established by the Board of Regents,

  3  pursuant to s. 240.209(3)(o)(p).

  4         Section 7.  Subsection (5) of section 240.531, Florida

  5  Statutes, is amended to read:

  6         240.531  Establishment of educational research centers

  7  for child development.--

  8         (5)  Each educational research center for child

  9  development shall be funded by a portion of the Capital

10  Improvement Trust Fund fee established by the Board of Regents

11  pursuant to s. 240.209(3)(g)(h).  Each university which

12  establishes a center shall receive a portion of such fees

13  collected from the students enrolled at that university,

14  usable only at that university, equal to 22.5 cents per

15  student per credit hour taken per term, based on the summer

16  term and fall and spring semesters. This allocation shall be

17  used by the university only for the establishment and

18  operation of a center as provided by this section and rules

19  promulgated hereunder.  Said allocation may be made only after

20  all bond obligations required to be paid from such fees have

21  been met.

22         Section 8.  Subsection (3) of section 240.262, Florida

23  Statutes, is repealed.

24         Section 9.  Subsection (3) of section 240.326, Florida

25  Statutes, is repealed.

26         Section 10.  Subsection (4) of section 240.40208,

27  Florida Statutes, is repealed.

28         Section 11.  Section 240.6055, Florida Statutes, is

29  repealed.

30         Section 12.  Paragraph (r) of subsection (1) of section

31  246.041, Florida Statutes, is amended to read:

  1         246.041  Powers and duties of board.--

  2         (1)  The board shall:

  3         (r)  Provide information and documentation on an annual

  4  basis to the Office of Student Financial Assistance of the

  5  Department of Education regarding the requirements set forth

  6  for nonpublic colleges in s. 240.605, relating to William L.

  7  Boyd, IV, Florida resident access grants, s. 240.6055,

  8  relating to access grants for community college graduates, and

  9  s. 240.609, relating to Florida postsecondary endowment

10  grants.

11         Section 13.  This act shall take effect upon becoming a

12  law.
