11  Senator McKay moved the following amendment:

13         Senate Amendment 

14         On page 5, lines 25-31, delete those lines

15

16  and insert:

17         (4)  Under this act, the state shall be a payor of last

18  resort with regard to any net financial deficit. The

19  direct-support organization authorized under section 288.1229,

20  Florida Statutes, may not permit the security provided by the

21  state pursuant to this act to be accessed to cover any net

22  financial deficit indemnified by the state under the games

23  support contracts until:

24         (a)  The security provided by the local organizing

25  committee pursuant to this act is fully expended and

26  exhausted;

27         (b)  Any security provided by any other person or

28  entity is fully expended and exhausted;

29         (c)  The limits of all available insurance policies

30  covering the net financial deficit, or any expense or

31  liability used in determining the net financial deficit, have

 1  been fully expended and exhausted; and

 2         (d)  Contribution has been sought, where practical and

 3  feasible, from all persons who bear any legal responsibility
