15         On page 41, line 13,

17  insert:

18         Section 9.  Subsections (1) and (3) of section

19  112.3231, Florida Statutes, are amended to read:

20         112.3231  Time limitations.--

21         (1)  On or after October 1, 1993, All sworn complaints

22  alleging a violation of this part, or of any other breach of

23  the public trust within the jurisdiction of the Commission on

24  Ethics under s. 8, Art. II of the State Constitution, shall be

25  filed with the commission within 5 years of the alleged

26  violation or other breach of the public trust. For information

27  or referrals received by the Commission pursuant to s.

28  112.324, the determination by at least seven of the members

29  that the information or referral is deemed sufficient to

30  indicate a breach of the public trust shall be made within

31  five years of the alleged violation.

 1         (3)  The applicable period of limitation is tolled on

 2  the day a sworn complaint against the public officer,

 3  employee, or candidate is filed with the Commission on Ethics.

 4  For information or referrals received by the Commission

 5  pursuant to s. 112.324, the applicable period of limitation is

 6  tolled upon a determination by at least seven members of the

 7  Commission that the information or referral is deemed

 8  sufficient. If it can be concluded from the face of the

 9  complaint that the applicable period of limitation has run,

10  the complaint shall be dismissed and the commission shall

11  issue a public report.
