2 An act relating to disposition of civil
3 penalties; amending s. 318.21, F.S.; revising
4 language with respect to a fee distributed to
5 the counties from each moving traffic violation
6 to be used for participation in an
7 intergovernmental radio communication program;
8 providing for the use of such funds if the
9 county is not participating in such a program
10 or if a municipality maintains a radio
11 communication program independent of the
12 county; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (10) of section 318.21, Florida
17 Statutes, is amended to read:
18 318.21 Disposition of civil penalties by county
19 courts.--All civil penalties received by a county court
20 pursuant to the provisions of this chapter shall be
21 distributed and paid monthly as follows:
22 (10) Twelve dollars and fifty cents from each moving
23 traffic violation must be used by the county to fund that
24 county's participation in an intergovernmental radio
25 communication program approved by the Department of Management
26 Services. If the county is not participating in such a
27 program, or if a municipality maintains a radio communication
28 program independent of the county, funds collected may must be
29 used to fund local law enforcement automation and must be
30 distributed to the municipality or special improvement
31 district in which the violation occurred or to the county if

1 the violation occurred within the unincorporated area of the
2 county.
3 Section 2. This act shall take effect July 1, 2000.

Revises a provision of law which sets aside twelve dollars and
8 fifty cents from each moving traffic violation in a county to
fund that county's participation in an intergovernmental radio
9 communication program. Provides that if the county is not
participating in such a program, or if a municipality
10 maintains a radio communication program independent of the
county, funds collected may be used to fund local enforcement
11 automation and must be distributed to the municipality or
special improvement district in which the violation occurred
12 or to the county if the violation occurred within the
unincorporated area of the county.
