  1                      A bill to be entitled

  2         An act relating to Medicaid; amending s.

  3         409.904, F.S.; amending criteria governing

  4         certain persons' eligibility to receive

  5         optional payments under Medicaid; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Subsection (1) of section 409.904, Florida

11  Statutes, is amended to read:

12         409.904  Optional payments for eligible persons.--The

13  agency may make payments for medical assistance and related

14  services on behalf of the following persons who are determined

15  to be eligible subject to the income, assets, and categorical

16  eligibility tests set forth in federal and state law.  Payment

17  on behalf of these Medicaid eligible persons is subject to the

18  availability of moneys and any limitations established by the

19  General Appropriations Act or chapter 216.

20         (1)  A person who is age 65 or older or is determined

21  to be disabled, whose income is at or below 200 100 percent of

22  federal poverty level, and whose assets do not exceed

23  established limitations. In determining eligibility, an assets

24  test is not required.

25         Section 2.  This act shall take effect July 1, 2000.
