1 A bill to be entitled
2 An act relating to hospitals and other licensed
3 facilities; amending s. 395.0197, F.S.;
4 requiring the Agency for Health Care
5 Administration to annually publish hospital
6 report cards; requiring that the report cards
7 be available through the Internet and by other
8 means of distribution; requiring that the
9 report cards list the adverse incidents
10 reported by the facility to the Agency for
11 Health Care Administration; specifying the
12 information to be included in the report cards;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsection (18) of section 395.0197,
18 Florida Statutes, is amended to read:
19 395.0197 Internal risk management program.--
20 (18) The agency shall annually publish hospital a
21 report cards summarizing the information contained in the
22 annual incident reports submitted by licensed facilities
23 pursuant to subsection (6) and disciplinary actions reported
24 to the agency pursuant to s. 395.0193. The hospital report
25 cards must be made available to the public through the
26 Internet and other commonly used means of distribution no
27 later than July 1 of each year. The hospital report cards must
28 be organized by county and, at a minimum, present an itemized
29 list showing for each hospital in the state summarize:
30 (a) The name and address of the hospital.

1 (b) Whether the hospital is private, for profit, not
2 for profit, or public.
3 (c) The total number of beds.
4 (d) A description of the categories of services
5 provided by the hospital.
6 (e)(a) The number of adverse incidents, by category of
7 reported incident, and by type of professional involved.
8 (f) A listing, by category, of the types of
9 operations, diagnostic or treatment procedures, or other
10 actions or inactions that resulted in the adverse incidents,
11 and the number of adverse incidents in each category.
12 (g)(b) Types of malpractice claims filed, by type of
13 professional involved.
14 (h)(c) Disciplinary actions taken against
15 professionals, by type of professional involved.
16 Section 2. This act shall take effect upon becoming a
17 law.

20 SENATE SUMMARY
21 Requires that the Agency for Health Care Administration
publish hospital report cards by July 1 of each year
22 which list the adverse incidents reported by each
hospital in the state. Requires that the report cards be
23 available through the Internet. Provides requirements for
the information to be included in the report cards. (See
