13         Amendment to Amendment (021283) (with title amendment) 

14         On page 33, between lines 16 and 17,

16  insert:

17         Section 24.  Section 403.066, Florida Statutes, is

18  created to read:

19          403.066  Environmental Justice Impact Statement--  No

20  permit shall be issued for an aquifer storage and recovery

21  project, pursuant to s. 403.065, until the permittee has

22  prepared an environmental justice impact statement and the

23  statement has been approved by the Department of Environmental

24  Protection.  The purpose of this statement is to determine

25  whether the proposed project is going to impose environmental

26  or health burdens on low-income, people of color living above

27  the zone of discharge or potentially affected by the

28  project.  The environmental justice impact statement shall

29  include, but not be limited, to the following:

30         1.  An identification of low-income, people of color

31  who live above the zone of discharge or who may be affected by

  1  the aquifer storage and recovery project;

  2         2.  An identification of the number and location of

  3  private wells located above the zone of discharge or which

  4  withdraw groundwater which may be affected by the aquifer

  5  storage and recovery project;

  6         3.  A statement of the aquifer storage and recovery

  7  project's impacts on public health and environment and any

  8  provision made to minimize the risk to public health and the

  9  environment; and,

10         4.  An analysis of the social and economic impacts of

11  the aquifer storage and recovery project on the affected

12  community, including changes in property values, community

13  perception, and other costs.

14         Section 25.  Section 258.398, Florida Statutes, 1997

15  edition, is repealed.

22  insert:

23         creating s. 403.066, F.S.; requiring

24         environmental justice impact statements under

25         certain conditions; repealing s. 258.398, F.S.;

26         removing designation of Lake Weir as an aquatic

27         preserve;
