16 insert:
17 Section 39. Paragraph (h) of subsection (1) of section
18 260.016, Florida Statutes, is created to read:
19 260.016 General powers of the department.--
20 (1) The department may:
21 (h) Receive or accept from any legal source, grants
22 for the purpose of providing or improving public greenways and
23 trails, and the department is authorized to disburse funds as
24 pass-through grants to federal, state, or local government
25 agencies, recognized tribal units, or to nonprofit entities
26 created for this purpose. The department has authority to
27 adopt rules pursuant to s. 120.536(1) and 120.54 to implement
28 the provisions of this subsection. Such rules shall provide,
29 but are not limited to, the following: procedures for grant
30 administration and accountability; eligibility, selection
31 criteria; maximum grant amounts and number of pending grants;

1 dedication requirements; and conversion procedures and
2 requirements.
3 Section 40. Subsection (1) of s. 375.075, Florida
4 Statutes, is amended to read:
5 375.075 Outdoor recreation; financial assistance to
6 local governments.--
7 (1) The Department of Environmental Protection is
8 authorized, pursuant to s. 370.023, to establish the Florida
9 Recreation Development Assistance Program to provide grants to
10 qualified local governmental entities to acquire or develop
11 land for public outdoor recreation purposes. To the extent not
12 needed for debt service on bonds issued pursuant to s.
13 375.051, each fiscal year through fiscal year 2000-2001, the
14 department shall develop and plan a program which shall be
15 based upon funding of not less than 5 percent of the money
16 credited to the Land Acquisition Trust Fund pursuant to s.
17 201.15(2) and (3) in that year. Beginning fiscal year
18 2001-2002, the department shall develop and plan a program
19 which shall be based upon funding provided from the Florida
20 Forever Trust Fund pursuant to s. 259.105(3)(c).
