1 A bill to be entitled
2 An act relating to university student judicial
3 proceedings; amending s. 120.81, F.S.; revising
4 who appoints members to a committee of the
5 Board of Regents; revising rulemaking
6 procedures regarding rules that govern student
7 judicial proceedings; requiring the standing
8 committee to periodically review the rules and
9 statutes being implemented and recommend
10 necessary revisions; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (g) of subsection (1) of section
16 120.81, Florida Statutes, is amended to read:
17 120.81 Exceptions and special requirements; general
18 areas.--
19 (1) EDUCATIONAL UNITS.--
20 (g)1. Sections 120.569 and 120.57 do not apply to any
21 proceeding in which the substantial interests of a student are
22 determined by the State University System or a community
23 college district.
24 2. The Board of Regents shall establish a standing
25 committee, at least one-half half of the members of which whom
26 shall be appointed by the Florida Student Association, Inc.
27 Council of Student Body Presidents, which shall make
28 recommendations to the Board of Regents regarding establish
29 rules and guidelines for ensuring fairness and due process in
30 judicial proceedings involving students in the State
31 University System. The Board of Regents shall adopt rules

1 based on these recommendations. The standing committee shall
2 review these rules at least once every 4 years and shall
3 recommend necessary revisions to such rules, or to the
4 specific law being implemented by such rules, to the Board of
5 Regents.
6 Section 2. This act shall take effect September 1,
7 2000.
