14         On page 1, line 13,

16  insert:

17         Section 1.  Section 497.345, Florida Statutes, is

18  amended to read:

19         (4)  A county or municipality, or any other party, may

20  not take action to maintain a cemetery which has been

21  abandoned for at least 20 years and which is located within a

22  county with a population of less than 250,000 based on the

23  1990 decennial census, and which is situated within a

24  residential neighborhood on private property which is no

25  larger than 3.5 acres in size, the owner having obtained legal

26  title to the property no later than January 1, 1998, without

27  the express permission of the private property owner, other

28  than to continue basic maintenance of existing cemetery sites.

29  No privately solicited funds or funds authorized for public

30  expenditure pursuant to subsection (1) may be used on such

31  property without the express permission of the private
