16 and insert:
17 (6) LIMITATION ON DUPLICATION OF GOVERNMENT
18 REGULATION.--It is the intent of the Legislature to eliminate
19 duplication of regulatory authority over farm operations as
20 expressed in this subsection. Except when the activity of a
21 farm operation takes place within a wellfield protection area
22 as defined in an ordinance adopted by a local government and
23 as other wise provided for in this section and s. 487.051(2),
24 and notwithstanding any other provision of law, a local
25 government may not adopt any ordinance, rule, regulation, or
26 policy to prohibit, restrict, regulate or otherwise limit an
27 activity of a bona fide farm operation on land classified as
28 agricultural land pursuant to s. 193.461, where such activity
29 is regulated through implemented best management practices
30 developed by the Department of Environmental Protection, the
31 Department of Agriculture and Consumer Services, or water

1 management districts and adopted pursuant to chapter 120 as
2 part of a statewide or regional program. This subsection does
3 not apply to powers of local approved environmental programs
4 authorized by law in s. 403.182. This subsection may not be
5 construed to limit the powers and duties provided for in s.
6 373.4592 or to limit the powers and duties of local
7 governments to address emergencies as provided for in chapter
8 252.
