  1                      A bill to be entitled

  2         An act relating to county government; amending

  3         s. 125.01, F.S.; revising provisions which

  4         specify that no referendum is required for the

  5         levy of ad valorem taxes by a county for county

  6         purposes or for a municipal service taxing

  7         unit, to provide an exception when the county

  8         charter requires a referendum; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Paragraph (r) of subsection (1) of section

14  125.01, Florida Statutes, is amended to read:

15         125.01  Powers and duties.--

16         (1)  The legislative and governing body of a county

17  shall have the power to carry on county government.  To the

18  extent not inconsistent with general or special law, this

19  power includes, but is not restricted to, the power to:

20         (r)  Levy and collect taxes, both for county purposes

21  and for the providing of municipal services within any

22  municipal service taxing unit, and special assessments; borrow

23  and expend money; and issue bonds, revenue certificates, and

24  other obligations of indebtedness, which power shall be

25  exercised in such manner, and subject to such limitations, as

26  may be provided by general law. There shall be no referendum

27  required for the levy by a county of ad valorem taxes, both

28  for county purposes and for the providing of municipal

29  services within any municipal service taxing unit, unless a

30  referendum is required by the county charter.
