18 Section 18. Subsections (1) and (2) of section
19 318.1451, Florida Statutes, are amended to read:
20 318.1451 Driver improvement schools.--
21 (1)(a) The Department of Highway Safety and Motor
22 Vehicles shall approve the courses of all driver improvement
23 schools, as the courses relate to ss. 318.14(9), 322.0261,
24 322.095, and 322.291. The chief judge of the applicable
25 judicial circuit may establish requirements regarding the
26 location of schools within the judicial circuit. A person may
27 engage in the business of operating a driver improvement
28 school that offers department-approved courses related to ss.
29 318.14(9), 322.0261, 322.095, and 322.291.
30 (b) The Department of Highway Safety and Motor
31 Vehicles shall approve and regulate courses that use

1 technology as the delivery method of all driver improvement
2 schools as the courses relate to ss. 318.14(9) and 322.0261.
3 (2)(a) In determining whether to approve the courses
4 referenced in this section, the department shall consider
5 course content designed to promote safety, driver awareness,
6 crash avoidance techniques, and other factors or criteria to
7 improve driver performance from a safety viewpoint.
8 (b) In determining whether to approve courses of
9 driver improvement schools that use technology as the delivery
10 method as the courses relate to ss. 318.14(9) and 322.0261,
11 the department shall consider only those courses submitted by
12 a person, business, or entity which have approval for
13 statewide delivery.

18 On page 41, line 23, of the amendment

20 after the semicolon insert:
21 providing the Department of Highway Safety and
22 Motor Vehicles regulatory authority over the
23 approval process for courses related to basic

25 as the delivery method; redefining the term
26 "approved courses" to mean those courses which
27 have passed and have maintained standards
28 approved for statewide delivery;
