11  Senator Carlton moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 1, line 13,

16  insert:

17         Section 1.  Subsection (4) is added to section 497.345,

18  Florida Statutes, to read:

19         497.345  Abandoned cemeteries; immunity; actions.--

20         (4)  A county or municipality, or any other party, may

21  not take action to maintain a cemetery which has been

22  abandoned for at least 20 years and which is located within a

23  county with a population of less than 250,000 based on the

24  1990 decennial census, and which is situated within a

25  residential neighborhood on private property which is no

26  larger than 3.5 acres in size, the owner having obtained legal

27  title to the property no later than January 1, 1998, without

28  the express permission of the private property owner, other

29  than to continue basic maintenance of existing cemetery sites.

30  No privately solicited funds or funds authorized for public

31  expenditure pursuant to subsection (1) may be used on such
