  1                      A bill to be entitled

  2         An act relating to drug-free workplaces;

  3         amending s. 440.102, F.S.; requiring certain

  4         contractors to implement a drug-free workplace

  5         program under certain circumstances; providing

  6         an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (15) is added to section

11  440.102, Florida Statutes, to read:

12         440.102  Drug-free workplace program requirements.--The

13  following provisions apply to a drug-free workplace program

14  implemented pursuant to law or to rules adopted by the Agency

15  for Health Care Administration:

16         (15)  STATE CONSTRUCTION CONTRACTS.--Each contractor,

17  as defined in part I or part II of chapter 489, with more than

18  three employees performing construction work pursuant to a

19  state contract in excess of $10,000, which contract was let

20  pursuant to chapter 235, chapter 255, or chapter 944, shall be

21  required to implement a drug-free workplace program pursuant

22  to this section.

23         Section 2.  This act shall take effect October 1, 2000.

      Requires building construction contractors and electrical
28    and alarm system contractors with more than three
      employees performing construction work pursuant to a
29    state contract in excess of $10,000 relating to public
      school system facilities, public property, and publicly
30    owned buildings, or state correctional system facilities,
      to implement a drug-free workplace program.
