  1                      A bill to be entitled

  2         An act relating to motor vehicle and casualty

  3         policies; creating s. 627.72615, F.S.;

  4         providing that such policies are incontestable

  5         after they have been in effect for a specified

  6         period; providing an exception; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 627.72615, Florida Statutes, is

12  created to read:

13         627.72615  Incontestability.--An insurance policy

14  issued under this part must provide that it is incontestable,

15  except for nonpayment of premium, during the lifetime of the

16  insured after it has been in effect for 1 year from the date

17  of issuance. Renewal policies are considered to be the same

18  policy for purposes of this section.

19         Section 2.  This act shall take effect July 1, 2000.

22                          SENATE SUMMARY

23    Provides that motor vehicle and casualty contracts are
      incontestable, except for nonpayment of premium, after
24    they have been in effect for 1 year.
