2 An act relating to trust funds; creating s.
3 373.472, F.S.; creating the Save Our Everglades
4 Trust Fund within the Department of
5 Environmental Protection; providing for sources
6 of funds and purposes; providing an exemption
7 from service charges; providing for retention
8 of interest and other earnings; providing for
9 annual carryforward of funds; providing for
10 future review and termination or re-creation of
11 the trust fund; providing a contingent
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 373.472, Florida Statutes, is
17 created to read:
18 373.472 Save Our Everglades Trust Fund.--
19 (1) There is created within the Department of
20 Environmental Protection the Save Our Everglades Trust Fund.
21 Funds in the trust fund shall be expended to implement the
22 comprehensive plan defined in s. 373.470(2)(a). The trust fund
23 shall serve as the repository for state, local, and federal
24 project contributions in accordance with s. 373.470(4).
25 (2) The trust fund is not subject to the service
26 charge described in s. 215.20(1). All income of a revenue
27 nature, including interest or other earnings received or
28 credited by the trust fund, shall be credited to the fund.
29 (3) Notwithstanding the provisions of s. 216.301 and
30 pursuant to s. 216.351, any balance in the trust fund at the
31 end of any fiscal year shall remain in the trust fund at the

1 end of the year and shall be available for carrying out the
2 purposes of the trust fund.
3 (4) Pursuant to the provisions of s. 19(f)(2), Art.
4 III of the State Constitution, the Save Our Everglades Trust
5 Fund shall, unless terminated sooner, terminate on July 1,
6 2004. Prior to its scheduled termination, the trust fund shall
7 be reviewed as provided in s. 215.3206(1) and (2).
8 Section 2. This act shall take effect July 1, 2000, if
9 HB 221 or similar legislation is adopted in the same
10 legislative session or an extension thereof and becomes law.
