18 Section 10. (1) Emergency Services Task
19 Force.--Effective July 1, 2000, there is hereby created the
20 Emergency Services Task Force. The task force shall be
21 appointed by the Secretary of the Department of Health and the
22 Executive Director of the Agency for Health Care
23 Administration and shall consist of:
24 a. The Secretary of the Department of Health or his
25 designee;
26 b. The Executive Director of the Agency for Health
27 Care Administration or his designee;
28 c. One representative from the Executive Office of the
29 Governor;
30 d. One representative from a non-profit hospital;
31 e. One representative from a for-profit hospital;

1 f. One representative from a statutory rural hospital;
2 g. One representative from a statutory teaching
3 hospital;
4 h. One emergency physician;
5 i. Two physicians from a specialty utilized in the
6 provision of emergency services and care;
7 j. One physician representing the Board of Medicine;
8 k. One representative from a private emergency medical
9 services provider;
10 l. One representative from a county emergency medical
11 services provider;
12 m. One representative from a municipality emergency
13 medical services provider; and
14 n. One emergency medical services medical director.
15 (2) Sponsoring agencies or organizations must fund the
16 travel and related expenses of their appointed members on the
17 commission. The task force shall be staffed by employees of
18 the Department of Health.
19 (3) The task force shall study and make
20 recommendations concerning:
21 a. Trends and issues relating to legislative,
22 regulatory, or private sector solutions for handling staffing
23 and coverage of physicians and other ancillary services and
24 providers relative to provision of hospital-based emergency
25 services and care.
26 b. Trends and issues relating to legislative,
27 regulatory, local community, or other solutions for the
28 handling of hospital diversion of emergency medical services
29 or closure of hospital emergency departments.
30 c. The impact of unfunded mandates and uncompensated
31 care on the provision of emergency services and care,

1 including but not limited to the costs of uncompensated or
2 under-compensated care borne by physicians, hospitals, and
3 emergency medical services providers in Florida relative to
4 emergency services and care; the impact of uncompensated or
5 under-compensated care on maintaining hospital-based emergency
6 services and care; the costs and effects of financing
7 24-hour-a-day, 365-days-a-year availability of emergency
8 services and care; the costs and availability of physician
9 coverage; and the impact of uncompensated or under-compensated
10 care on emergency medical services.
11 d. The factors affecting specialty physician coverage
12 of emergency services and care and recommendations for
13 addressing specialty physician emergency care coverage in
14 Florida hospitals or communities.
15 e. The factors affecting diversion of emergency
16 medical services or closing of hospitals to emergency medical
17 services and recommendations that address the handling of such
18 occurrences relative to the continued provision of emergency
19 medical services within the community, and development of
20 recommendations relative to policies or procedures relative to
21 handling such diversion or closing of hospital emergency
22 medical facilities.
23 (4) The advisory group shall be appointed and convened
24 by July 1, 2000, and shall meet in Tallahassee or in other
25 areas of the state as agreed upon by the Secretary of the
26 Department of Health and the Executive Director of the Agency
27 for Health Care Administration. The advisory group shall
28 submit its recommendations in a report, by January 1, 2001, to
29 the President of the Senate and the Speaker of the House of
30 Representatives. This provision shall be repealed on July 1,
31 2001.
