17 Section 23. Paragraph (o) of subsection (1) of section
18 440.102, Florida Statutes, is amended to read:
19 440.102 Drug-free workplace program requirements.--The
20 following provisions apply to a drug-free workplace program
21 implemented pursuant to law or to rules adopted by the Agency
22 for Health Care Administration:
23 (1) DEFINITIONS.--Except where the context otherwise
24 requires, as used in this act:
25 (o) "Safety-sensitive position" means, with respect to
26 a public employer, a position in which a drug impairment
27 constitutes an immediate and direct threat to public health or
28 safety, such as a position that requires the employee to carry
29 a firearm, perform life-threatening procedures, work with
30 confidential information or documents pertaining to criminal
31 investigations, or work with controlled substances; a position

3 employee is responsible for the well-being of a minor; a
