  2         An act relating to trust funds; creating s.

  3         380.5115, F.S.; creating a Florida Forever

  4         Program Trust Fund within the Department of

  5         Community Affairs; providing purposes;

  6         providing for a source of moneys; providing for

  7         annual carryforward of funds; providing for

  8         future review and termination or re-creation of

  9         the trust fund; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Section 380.5115, Florida Statutes, is

14  created to read:

15         380.5115  Florida Forever Program Trust Fund of the

16  Department of Community Affairs.--

17         (1)  There is created a Florida Forever Program Trust

18  Fund within the Department of Community Affairs to further the

19  purposes of part III of chapter 380 as specified in s.

20  259.105(3)(c). The trust fund shall receive funds pursuant to

21  s. 259.105(3)(c).

22         (2)  Notwithstanding the provisions of s. 216.301 and

23  pursuant to s. 216.351, any balance in the trust fund at the

24  end of any fiscal year shall remain in the trust fund at the

25  end of the year and shall be available for carrying out the

26  purposes of the trust fund.

27         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

28  III of the State Constitution, the trust fund shall, unless

29  terminated sooner, be terminated on July 1, 2004. Prior to its

30  scheduled termination, the trust fund shall be reviewed as

31  provided in s. 215.3206(1) and (2).

  1         Section 2.  This act shall take effect July 1, 2000.

      Creates a Florida Forever Program Trust Fund within the
  6    Department of Community Affairs to further the purposes
      of the Florida Communities Trust Act as specified and
  7    funded under the Florida Forever Act. Provides for annual
      carryforward of funds. Provides for future review and
  8    termination or re-creation of the trust fund.
