  1                      A bill to be entitled

  2         An act relating to public records; amending s.

  3         624.311, F.S.; providing an exemption from

  4         public records requirements for

  5         patient-identifying information contained in

  6         medical records of the Department of Insurance;

  7         providing for future legislative review and

  8         repeal; providing a statement of public

  9         necessity; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Subsection (5) is added to section 624.311,

14  Florida Statutes, to read:

15         624.311  Records; reproductions; destruction.--

16         (5)  Any patient-identifying information contained in

17  medical records received by the department is confidential and

18  exempt from s. 119.07(1), Florida Statutes, and s. 24(a),

19  Article I of the State Constitution. This subsection is

20  subject to the Open Government Sunset Review Act of 1995 in

21  accordance with s. 119.15, and shall stand repealed on October

22  2, 2005, unless reviewed and saved from repeal through

23  reenactment by the Legislature.

24         Section 2.  The Legislature finds that it is a public

25  necessity to protect the patient-identifying information

26  contained in medical records of the Department of Insurance.

27         Section 3.  This act shall take effect July 1, 2000.
