6 scores of students; providing bonuses for
7 teachers who provide advanced placement
8 instruction; creating s. 236.08103, F.S., the
9 "Equity in School-Level Funding Act"; requiring
10 school districts to allocate to each school
11 within the district a specified minimum
12 percentage of the funds generated by the school
13 based on the Florida Education Finance Program;
14 providing for graduated increases in such
15 percentage; providing for carryforward of
16 unused funds allocated to the schools;
17 providing for review of certain task force
18 recommendations for potential inclusion of
19 certain funds in the allocation methodology;
20 providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. Paragraph (m) of subsection (1) of section
25 236.081, Florida Statutes, is amended to read:
26 236.081 Funds for operation of schools.--If the annual
27 allocation from the Florida Education Finance Program to each
28 district for operation of schools is not determined in the
29 annual appropriations act or the substantive bill implementing
30 the annual appropriations act, it shall be determined as
31 follows:

1 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
2 OPERATION.--The following procedure shall be followed in
3 determining the annual allocation to each district for
4 operation:
5 (m) Calculation of additional full-time equivalent
6 membership based on college board advanced placement scores of
7 students.--A value of 0.24 full-time equivalent student
8 membership shall be calculated for each student in each
9 advanced placement course who receives a score of 3 or higher
10 on the College Board Advanced Placement Examination for the
11 prior year and added to the total full-time equivalent student
12 membership in basic programs for grades 9 through 12 in the
13 subsequent fiscal year. Each district must allocate at least
14 80 percent of the funds provided to the district appropriated
15 for advanced placement instruction, in accordance with this
16 paragraph, to the high school that generates the funds. The
17 school district shall distribute to each classroom teacher who
18 provided advanced placement instruction:
19 1. A bonus in an amount equal to 20 percent of the
20 funds generated by his or her students according to this
21 paragraph, for those teachers who provided advanced placement
22 instruction in a school that was designated as school
23 performance category "A," "B," or "C" during the previous
24 school year, pursuant to s. 229.57.
25 2. A bonus in an amount equal to 30 percent of the
26 funds generated by his or her students according to this
27 paragraph, for those teachers who provided advanced placement
28 instruction in a school that was designated as school
29 performance category "D" or "F" during the previous school
30 year, pursuant to s. 229.57.

1 A bonus awarded to a teacher according to this paragraph shall
2 be in addition to any regular wage or other bonus the teacher
3 has received or is scheduled to receive.
4 Section 2. Section 236.08103, Florida Statutes, is
5 created to read:
6 236.08103 Equity in School-Level Funding Act.--
7 (1) This section may be cited as the "Equity in
8 School-Level Funding Act."
9 (2)(a) Beginning in the 2000-2001 fiscal year,
10 district school boards shall allocate to each school within
11 the district at least 50 percent of the funds generated by
12 that school based upon the Florida Education Finance Program
13 as provided in s. 236.081 and the General Appropriations Act,
14 including gross state and local funds, discretionary lottery
15 funds, and funds from the school district's current operating
16 discretionary millage levy.
17 (b) Beginning in the 2001-2002 fiscal year, district
18 school boards shall allocate to each school within the
19 district at least 65 percent of the funds generated by that
20 school based upon the Florida Education Finance Program as
21 provided in s. 236.081 and the General Appropriations Act,
22 including gross state and local funds, discretionary lottery
23 funds, and funds from the school district's current operating
24 discretionary millage levy.
25 (c) Beginning in the 2002-2003 fiscal year, district
26 school boards shall allocate to each school within the
27 district at least 80 percent of the funds generated by that
28 school based upon the Florida Education Finance Program as
29 provided in s. 236.081 and the General Appropriations Act,
30 including gross state and local funds, discretionary lottery

1 funds, and funds from the school district's current operating
2 discretionary millage levy.
3 (d) Beginning in the 2003-2004 fiscal year, district
4 school boards shall allocate to each school within the
5 district at least 95 percent of the funds generated by that
6 school based upon the Florida Education Finance Program as
7 provided in s. 236.081 and the General Appropriations Act,
8 including gross state and local funds, discretionary lottery
9 funds, and funds from the school district's current operating
10 discretionary millage levy.

12 Total funding for each school shall be recalculated during the
13 year to reflect the revised calculations under the Florida
14 Education Finance Program by the state and the actual weighted
15 full-time equivalent students reported by the school during
16 the full-time equivalent student survey periods designated by
17 the Commissioner of Education. If the district school board is
18 providing programs or services to students funded by federal
19 funds, any eligible students enrolled in the schools in the
20 district shall be provided federal funds.
21 (3) Funds allocated to a school pursuant to this
22 section which are unused at the end of the fiscal year shall
23 not revert to the district, but shall remain with the school.
24 These carryforward funds may be used for any purpose provided
25 by law at the discretion of the principal of the school.
26 (4) Recommendations made by the Governor's Equity in
27 Educational Opportunity Task Force shall be reviewed to
28 identify potential categorical funds to be included in the
29 district allocation methodology required in subsection (2).
30 Section 3. This act shall take effect July 1, 2000.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
2 SB 2030

4 The committee substitute changes the calculation of the bonus
for the teachers of advance placement courses whose students
5 score 3 or higher on the College Board Advance Placement
Examination from a percentage of the district's.24 full-time
6 equivalent student funds to a percentage of the .24 full-time
student funds generated by students scoring 3 or higher in the
7 teacher's class.
8 The committee substitute adds the "Equity in School-Level
Funding Act." Beginning in 2000-2001 district school boards
9 shall allocate to each 50 percent of the funds generated by
the school based upon the Florida Education Finance Program
10 and the General Appropriations Act, including gross state and
local funds, discretionary lottery funds, and funds from the
11 school district's current operating discretionary millage
levy. The percentage of allocation to the school will increase
12 15 percent each year through 2003-2004 when schools will be
receiving 95 percent of the funds generated.

Dollars unused at the end of the fiscal year will carry foward
14 to be used for any purpose provided by law, and may be spent
at the discretion of the principal.

A review of the Governor's Equity in Education Opportunity
16 Task Force recommendations shall be made for possible
inclusion in the district allocation methodology as described
17 in the bill.
