11  Senator Clary moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 5, lines 1-16, delete those lines

15

16  and insert:

17         Section 1.  Paragraph (l) of subsection (1) of section

18  20.43, Florida Statutes, is amended and subsection (8) is

19  added to that section to read:

20         20.43  Department of Health.--There is created a

21  Department of Health.

22         (1)  The purpose of the Department of Health is to

23  promote and protect the health of all residents and visitors

24  in the state through organized state and community efforts,

25  including cooperative agreements with counties.  The

26  department shall:

27         (l)  Include in the department's strategic plan

28  developed under s. 186.021 an assessment of Biennially

29  publish, and annually update, a state health plan that

30  assesses current health programs, systems, and costs; makes

31  projections of future problems and opportunities; and

 1  recommended recommends changes that are needed in the health

 2  care system to improve the public health.

 3         (8)  The department may hold copyrights, trademarks,

 4  and service marks and enforce its rights with respect thereto.

 9         On page 1, line 7, after the word "plan;"

11  insert:

12         authorizing the department to hold copyrights,

13         trademarks, and service marks and to enforce

14         its rights to them;
