18         Section 135.  Section 446.50, Florida Statutes, is

19  amended to read:

20         446.50  Displaced homemakers; multiservice programs;

21  report to the Legislature; Displaced Homemaker Trust Fund

22  created.--

23         (1)  INTENT.--It is the intent of the Legislature to

24  require the Agency for Workforce InnovationDivision of

25  Community Colleges of the Department of Education to enter

26  into contracts with, and make grants to, public and nonprofit

27  private entities for purposes of establishing multipurpose

28  service programs to provide necessary training, counseling,

29  and services for displaced homemakers so that they may enjoy

30  the independence and economic security vital to a productive

31  life.

 1         (2)  DEFINITIONS.--For the purposes of this section

 2  act:

 3         (a)  "Displaced homemaker" means an individual who:

 4         1.  Is 35 years of age or older;

 5         2.  Has worked in the home, providing unpaid household

 6  services for family members;

 7         3.  Is not adequately employed, as defined by rule of

 8  the division;

 9         4.  Has had, or would have, difficulty in securing

10  adequate employment; and

11         5.  Has been dependent on the income of another family

12  member but is no longer supported by such income, or has been

13  dependent on federal assistance.

14         (b)  "Agency Division" means the Agency for Workforce

15  Innovation Division of Community Colleges of the Department of

16  Education.

17         (3)  AGENCY DIVISION POWERS AND DUTIES.--

18         (a)  The agency division, under plans established by

19  Workforce Florida, Inc., shall establish, or contract for the

20  establishment of, programs for displaced homemakers which

21  shall include:

22         1.  Job counseling, by professionals and peers,

23  specifically designed for a person entering the job market

24  after a number of years as a homemaker.

25         2.  Job training and placement services, including:

26         a.  Training programs for available jobs in the public

27  and private sectors, taking into account the skills and job

28  experiences of a homemaker and developed by working with

29  public and private employers.

30         b.  Assistance in locating available employment for

31  displaced homemakers, some of whom could be employed in

 1  existing job training and placement programs.

 2         c.  Utilization of the services of the state employment

 3  service, which shall cooperate with the division in locating

 4  employment opportunities.

 5         3.  Financial management services providing information

 6  and assistance with respect to insurance, including, but not

 7  limited to, life, health, home, and automobile insurance, and

 8  taxes, estate and probate problems, mortgages, loans, and

 9  other related financial matters.

10         4.  Educational services, including high school

11  equivalency degree and such other courses as the agency

12  division determines would be of interest and benefit to

13  displaced homemakers.

14         5.  Outreach and information services with respect to

15  federal and state employment, education, health, and

16  unemployment assistance programs which the division determines

17  would be of interest and benefit to displaced homemakers.

18         (b)1.  The agency division shall enter into contracts

19  with, and make grants to, public and nonprofit private

20  entities for purposes of establishing multipurpose service

21  programs for displaced homemakers under this section act.

22  Such grants and contracts shall be awarded pursuant to chapter

23  287 and based on criteria established in the state plan

24  developed pursuant to this section. The agency division shall

25  designate catchment areas which together shall comprise the

26  entire state, and, to the extent possible from revenues in the

27  Displaced Homemaker Trust Fund, the agency division shall

28  contract with, and make grants to, entities which will serve

29  entire catchment areas so that displaced homemaker service

30  programs are available statewide.  These catchment areas shall

31  be coterminous with the state's workforce development regions.

 1  The agency division may give priority to existing displaced

 2  homemaker programs when evaluating bid responses to the

 3  agency's division's request for proposals.

 4         2.  In order to receive funds under this section, and

 5  unless specifically prohibited by law from doing so, an entity

 6  that provides displaced homemaker service programs must, by

 7  the 1991-1992 fiscal year, receive at least 25 percent of its

 8  funding from one or more local, municipal, or county sources

 9  or nonprofit private sources.  In-kind contributions may be

10  evaluated by the agency division and counted as part of the

11  required local fundi ng.

12         3.  The agency  division shall require an entity that

13  receives funds under this section to maintain appropriate data

14  to be compiled in an annual report to the division.  Such data

15  shall include, but shall not be limited to, the number of

16  clients served, the units of services provided, designated

17  client-specific information including intake and outcome

18  information specific to each client, costs associated with

19  specific services and program administration, total program

20  revenues by source and other appropriate financial data, and

21  client followup information at specified intervals after the

22  placement of a displaced home maker in a job.

23         (c)  The agency division shall consult and cooperate

24  with the Commissioner of Education, the United States

25  Commissioner of the Social Security Administration, and such

26  other persons in the executive branch of the state government

27  as the agency division considers appropriate to facilitate the

28  coordination of multipurpose service programs established

29  under this section act with existing programs of a similar

30  nature.

 1  positions relating to pro grams established under this section

 2  act shall, to the maximum extent practicable, be filled by

 3  displaced homemakers.

 4         (e)  The agency division shall adopt rules establishing

 5  minimum standards necessary for entities that provide

 6  displaced homemaker service programs to receive funds from the

 7  agency division and any other rules necessary to administer

 8  this section.

 9         (4)  STATE PLAN.--

10         (a)  The Agency for Workforce Innovation division shall

11  develop a 3-year state plan for the displaced homemaker

12  program which shall be updated annually. The plan must

13  address, at a minimum, the need for programs specifically

14  designed to serve displaced homemakers, any necessary service

15  components for such programs in addition to those enumerated

16  in this section, goals of the displaced homemaker program with

17  an analysis of the extent to which those goals are being met,

18  and recommendations for ways to address any unmet program

19  goals. Any request for funds for program expansion must be

20  based on the state plan.

21         (b)  Each annual update must address any changes in the

22  components of the 3-year state plan and a report which must

23  include, but need not be limited to, the following:

24         1.  The scope of the incidence of displaced homemakers;

25         2.  A compilation and report, by program, of data

26  submitted to the division pursuant to subparagraph 3. by

27  funded displaced homemaker service programs;

28         3.  An identification and description of the programs

29  in the state that receive funding from the division, including

30  funding information; and

31         4.  An assessment of the effectiveness of each

 1  displaced homemaker service program based on outcome criteria

 2  established by rule of the division.

 3         (c)  The 3-year state plan must be submitted to the

 4  President of the Senate, the Speaker of the House of

 5  Representatives, and the Governor on or before January 1, 2001

 6  1989, and annual updates of the plan must be submitted by

 7  January 1 of each subsequent year.

 8         (5)  DISPLACED HOMEMAKER TRUST FUND.--

 9         (a)  There is established within the State Treasury a

10  Displaced Homemaker Trust Fund to be used by the agency

11  division for its administration of the displaced homemaker

12  program and to fund displaced homemaker service programs

13  according to criteria established under this section.

14         (b)  The trust fund shall receive funds generated from

15  an additional fee on marriage license applications and

16  dissolution of marriage filings as specified in ss. 741.01(3)

17  and 28.101, respectively, and may receive funds from any other

18  public or private source.

19         (c)  Funds that are not expended by the agency division

20  at the end of the budget cycle or through a supplemental

21  budget approved by the agency division shall revert to the

22  trust fund.
