17 and insert:
18 (b) Employment services must be provided through the
19 one-stop delivery system Career Centers, under the guidance of
20 one-stop delivery system Career Center operators. One-stop
21 delivery system operators shall have overall authority for
22 directing the staff of the workforce system. Personnel matters
23 shall remain under the ultimate authority of the Agency for
24 Workforce Innovation. However, the one-stop delivery system
25 operator shall submit to the agency information concerning the
26 job performance of department employees who deliver employment
27 services. The agency shall consider any such information
28 submitted by the one-stop delivery system operator in
29 conducting performance appraisals of the employees.
30 (c) As a part of the memorandum of understanding under
31 this subsection, a regional workforce board may elect to enter

1 into an agreement with the Agency for Workforce Innovation
2 under which agency employees delivering employment services
3 shall be leased to the one-stop delivery system operator.
4 Notwithstanding any provisions in chapter 110 to the contrary,
5 an agency employee leased pursuant to this paragraph shall
6 retain the position classification as a state employee that he
7 or she held on the day before the lease agreement takes
8 effect, as well as any state employee personnel rights or
9 benefits associated with that position classification. This
10 lease agreement, at a minimum, must specify that:
11 1. The agency shall retain fiscal responsibility and
12 accountability for the administration of funds allocated to
13 the state under the Wagner-Peyser Act.
14 2. The agency shall retain ultimate authority over
15 personnel matters relating to an employee covered by the lease
16 agreement; however, the employee shall be under the day-to-day
17 supervision of the one-stop delivery system operator. The
18 one-stop delivery system operator shall submit to the agency
19 information relating to the job performance of agency
20 employees, as provided in paragraph (b).
