11  Senator King moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 60, lines 6 through 22....., delete those lines

15

16  and insert: (b)  A regional workforce board may not designate

17  as its one-stop delivery system operator any public or private

18  entity that is eligible to provide services under any state or

19  federal workforce program that is a mandatory or discretionary

20  partner in the region's one-stop delivery system. Workforce

21  Florida, Inc., may waive this prohibition upon a showing by

22  the regional workforce board that a fair and competitive

23  process was used in the selection.  As a condition of

24  authorizing a regional workforce board to designate such an

25  entity as its one-stop delivery system operator, Workforce

26  Florida, Inc., must require the regional workforce board to

27  demonstrate that safeguards are in place to ensure that the

28  one-stop delivery system operator will not exercise an unfair

29  competitive advantage or unfairly refer or direct customers of

30  the one-stop delivery system to services provided by that

31  one-stop delivery system operator.
